City Content i. City shall provide City Content for inclusion in the Software or the Cloud Hosted Service. City is responsible for the quality of the City Content provided. Consultant is responsible for the quality of the display or use of the City Content provided for inclusion in the City database.

City Content. City and its Authorized Users may upload, view and/or store monitoring results, reports and other information, data and/or text directly related to the Bluff Road Landfill or other applicable City sites (collectively, the "Content") on SCS eTools. By accessing or uploading any Content, City represents and warrants that: (a) City is the owner of such Content, or has been granted all rights necessary from the owner of such Content to access and/or submit such Content, and (b) the uploading, viewing, maintenance, and use of such Content on SCS eTools will not infringe or misappropriate the intellectual property rights or otherwise violate any laws or the rights of any third party. City is solely responsible for collecting, uploading, downloading, reviewing, using, and validating the Content, and for its accuracy. Consultant may remove nonconforming or offensive material.
