User Content. 6.1. All property rights arising out of use of the Platform and Services by the Users, including any questions, comments, suggestions, ideas, feedback or other information with respect to the Platform or the Services generated, posted or shared by the User (“User Content”) may be welcomed by Xxxxx, will not be deemed confidential and upon Xxxxx’s discretion will become the property of Zotlo or otherwise shall be transferred to Zotlo. Given that Xxxxx shall own all intellectual property rights of the User Content, Zotlo may, at its sole discretion, use the User Content for any lawful purpose and you acknowledge and agree that you have transferred or waived any related rights and cannot make any claims. Regardless of the ownership of the User Content (and whether Zotlo claims ownership or not) by posting, uploading, inputting, providing or submitting User Content, you are granting Zotlo necessary sublicensees permission to use User Content in connection with providing Services, using the Platform or other related purposes, including, without limitation, the license rights to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your User Content; to publish your name or other related information in connection with your User Content; and the right to sublicense such rights to any related third party. 6.2. You acknowledge that certain User Content may be viewed by third parties, other users of the Platform or through third party websites. It may be indexed by search engines and may accordingly be seen by third parties. Zotlo is under no obligation to post or use any User Content you may provide and Zotlo may remove any User Content at any time in its sole discretion. 6.3. You hereby warrant that (i) the User Content does not violate any rights of third parties, including moral rights, (ii) you have the right to submit such User Content on the Platform and you are not violating any laws, including data privacy regulations, by doing so and (iii) the User Content is, true, accurate, original and does not violate any intellectual property rights of third parties. 6.4. The User warrants that there shall be no recourse against Zotlo for any infringement (alleged or actual) and violation of third party rights. 6.5. You grant Zotlo the rights we need to use your content without attribution and to make reasonable adaptations of your content as necessary to render the Platform and provide the Services.

User Content. You own your User Content. By posting, displaying, sharing or distributing User Content on or through the Software, Site, or Services, you grant us, and any Third Party API Provider used in connection with the Services, a nonexclusive license to use the User Content solely for the purpose of operating the Services. Except as prohibited by applicable law, we may disclose any information in our possession (including User Content) in connection with your use of the Services, to: (a) comply with legal process; (b) enforce these Terms, (c) respond to your requests for customer service, or (d) protect the rights, property or personal safety of Exodus, our employees, directors or officers, partners and agents, or members of the public.

User Content. In connection with registration for a SalonSwipe Account, users may upload photos or other materials or information to the Services (“User Content”). You agree that you will not upload User Content to the Services unless you have created that content yourself, or you have permission from the copyright owner to do so. For any User Content that you upload to the Services, you grant us and our subsidiaries, affiliates, and successors a worldwide, non-exclusive, royalty-free, fully-paid, transferable, and sublicensable right to use, reproduce, modify, adapt, publish, prepare derivative works of, distribute, publicly perform, and publicly display that User Content throughout the world in any media in order to provide and promote the Services and SalonSwipe’s business. You retain all rights in your User Content, subject to the rights granted to SalonSwipe in this Agreement. You may modify or remove your User Content via your SalonSwipe Account or by terminating your SalonSwipe Account. You agree not to upload to the Services or otherwise post, transmit, distribute, or disseminate through the Services any material that: (a) is false, misleading, unlawful, obscene, indecent, lewd, pornographic, defamatory, libelous, threatening, harassing, hateful, abusive, or inflammatory; (b) encourages conduct that would be considered a criminal offense or gives rise to civil liability; (c) breaches any duty toward or rights of any person or entity, including rights of publicity or privacy; (d) contains corrupted data or any other harmful, disruptive, or destructive files; (e) advertises products or services competitive with SalonSwipe’s or its partners’ products and services, as determined by SalonSwipe in its sole discretion; or (f) in SalonSwipe’s sole judgment, is objectionable, restricts or inhibits any person or entity from using or enjoying any portion of the Services, or which may expose SalonSwipe, its affiliates, or users to harm or liability of any nature. Although SalonSwipe has no obligation to screen, edit, or monitor any User Content, SalonSwipe reserves the right, and has absolute discretion, to remove, screen, edit, or disable any User Content at any time and for any reason without notice. You understand that by using the Services, you may be exposed to User Content that is offensive, indecent, or objectionable. We take no responsibility and assume no liability for any User Content, including any loss or damage to any of your User Content.

User Content. Subject to our privacy policy, you agree that we may use, copy, modify, display and distribute any information, data, materials or other content (the “Content”) you provide to us for the purpose of providing the Service, and you hereby give us a license to do so. By submitting Content, you represent that you have the right to grant such Content license to us for the purposes set forth in this Agreement.

User Content. 3.1 You may submit Posted Information such as offering feedback, submitting inquiries and participating in the other interactive and community features of the Site. In providing feedback, please give clear, honest information about the Healthcare Provider and your experiences, but do not use inappropriate language, make gratuitous personal criticisms or comments or provide information that others could use to determine your identity. When participating in interactive or community aspects of the Services, please do not post any information that another user or Healthcare Provider may use to individually identify you, but please do include all relevant information in a concise manner to help us provide you with a helpful response. 3.2 We reserve the right to publish your Posted Information as part of the Services and to also remove your Posted Information for any reason. We are not, however, responsible for any failure or delay in posting or removing Posted Information. Keep in mind that the Posted Information of others is simply opinion and should not be relied on. 3.3 Without limiting the generality of the foregoing: (a) You are solely responsible for any Posted Information that you submit, publish or display through the Services or transmit to other members and/or other users of the Site. (b) You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. You may not submit any content or material that infringes, misappropriates or violates the intellectual property, publicity, privacy or other rights of any party. (c) You may not provide any Posted Information that falsely expresses or implies that such content or material is sponsored or endorsed by UBERDOC. (d) You may not provide any Posted Information that is unlawful or that promotes or encourages illegal activity. (e) You understand and agree that UBERDOC may (but is not obligated to) review and delete any Posted Information that in the sole judgment of UBERDOC violates these Terms of Use or the UBERDOC Privacy Policy, or which might be offensive, illegal, or that might violate the rights of, harm, or threaten the safety of other users or members of the Services and/or other website users. User Content. You are responsible for all data and information provided or uploaded by you to the Services (“User Content”), whether publicly posted (i.e., in a user forum, if applicable) or privately transmitted (i.e., to us in connection with a support request). You are solely responsible for the accuracy and completeness of User Content you submit, and represent and warrant that you have all rights required in order to post such User Content. We may, in our sole discretion, delete any User Content that we determine violates these Terms. To the extent that you provide us with or we may have access to any information that allows us to identify you or any other individual (“Personal Information”) in connection with your use of the Services, we will preserve, safeguard, and use such information as set forth in our Privacy Policy.

User Content. Client is solely responsible for the content of any postings, data, or transmissions using the Services ("Consent"), or any other use of the Services by Client or by any person or entity Client permits to access the Services (a "User"). Client represents and warrants that is and any User will not use the services for unlawful purposes (including without limitation infringement of copyright or trademark, misappropriation of trade secrets, wire fraud, invasion of privacy, pornography, obscenity and libel), or to interfere with or disrupt other network users, network services or network equipment. Disruptions include without limitation distribution of unsolicited advertising or chain letters, repeated harrassment of other network users, wrongly impersonating another such user, falsifying one's network identity for improper or illegal purposes, sending unsolicited mass e-mailings, propagation of computer worms and viruses, and using the network to make unauthorized entry to any other machine accessible via the network. If GlobalCenter has reasonable grounds to believe that Client or a User is utilizing the Services for any such illegal or disruptive purpose, GlobalCenter may suspend or terminate Services immediately upon notice to Client. Client shall defend, indemnify, hold harmless GlobalCenter from and against all liabilities and costs (including reasonable attorney's fees) arising from any and all claims by any person arising out of Client's use of the Services, including without limitation any content.

User Content. Depending on your use of the Service, you may share User Content with us. Except as provided in this Section 5, we obtain no rights under this Agreement from you (or your licensors) to Your Content. You consent to our use of Your Content to provide the Services to you. You are solely responsible for your use of our Services and your User Content. You assume all risks associated with use of your User Content, including any reliance on its accuracy, completeness or usefulness by others, or any disclosure of your User Content that personally identifies you or any third party. You hereby represent and warrant that your User Content does not violate our Acceptable Use Policy set forth in Section 7. You may not represent or imply to others that your User Content is in any way provided, sponsored or endorsed by Xxx Xxxxx. Since you alone are responsible for your User Content, you may expose yourself to liability if, for example, your User Content violates the Acceptable Use Policy. Sky Xxxxx is not obligated to backup any User Content, and your User Content may be deleted at any time without prior notice. You are solely responsible for creating and maintaining your own backup copies of your User Content if you desire.

User Content. WRP makes no effort to review any User Content for any purpose, including, inter alia, for accuracy, legality, or non-infringement. WRP is not responsible for any User Content, and you agree that regarding any User Content you provide to WRP that you are solely and exclusively responsible for any liability arising therefrom and that that content may be used lawfully and without restriction by you and WRP. We may, in our sole discretion, permit you to post, upload, publish, submit, or transmit User Content. By making available any User Content on or through the Services, you hereby grant to WRP a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license, with the right to sublicense, use, view, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, access and view such User Content on, through, or by means of the Services. WRP does not claim any ownership rights in any such User Content, and nothing in these Terms will be deemed to restrict any rights that you may have to use and exploit any such User Content. You represent and warrant that: (i) you either are the sole and exclusive owner of all User Content that you make available through the Services or you have all rights, licenses, consents and releases that are necessary to grant to WRP the rights in such User Content, as contemplated under these Terms; and (ii) neither the User Content nor your posting, uploading, publication, submission or transmittal of the User Content or WRP’s use of the User Content (or any portion thereof) on, through or by means of the Services will infringe, misappropriate or violate a third party’s patent, copyright, trademark, trade secret, moral rights or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation. Notwithstanding the foregoing, should you furnish WRP with photos to be used in connection with any Listing or for any other purpose, you agree that WRP is permitted to edit such photos, and the edited result shall constitute a derivative work that you agree is the sole and exclusive property of WRP and for which you agree that you forfeit any copyright claims against WRP, whether past, present, or future, threatened, or actual.

User Content. You may be able to upload, store, publish, display and distribute information, text, photos, videos and other content on or through the Services (collectively, "User Content"). User Content includes any content posted by you or by users of any of your websites hosted through the Services ("User Websites"). You are solely responsible for any and all User Content and any transactions or other activities conducted on or through User Websites. By posting or distributing User Content on or through the Services, you represent and warrant to Strat Hostess that (i) you have all the necessary rights to post or distribute such User Content, and (ii) your posting or distribution of such User Content does not infringe or violate the rights of any third party. Solely for purposes of providing the Services, you hereby grant to Strat Hostess a non- exclusive, royalty-free, worldwide right and license to: (i) use, reproduce, publicly perform, publicly display, modify, translate, excerpt (in whole or in part), publish and distribute User Content; and (ii) make archival or back-up copies of User Content and User Websites. Except for the rights expressly granted herein, Strat Hostess does not acquire any right, title or interest in or to the User Content, all of which shall remain solely with you. a. Strat Hostess exercises no control over, and accepts no responsibility for, User Content or the content of any information passing through Strat Hostess's computers, network hubs and points of presence or the Internet. Strat Hostess does not monitor User Content. However, you acknowledge and agree that Strat Hostess may, but is not obligated to, immediately take any corrective action in Strat Hostess's sole discretion, including without limitation removal of all or a portion of the User Content or User Websites, and suspend or terminate any and all Services without refund if you violate the terms of this Agreement. You hereby agree that Strat Hostess shall have no liability due to any corrective action that Strat Hostess may take.
