CLAIMS FOR OTHER THAN PROFESSIONAL LIABILITY. To the furthest extent permitted by Oregon law, Consultant shall defend, indemnify, and hold harmless the District and its officers, agents, and employees from and against all claims, suits, actions, losses, damages, liabilities, costs and expenses of whatsoever nature resulting from, arising out of, or relating to the activities of the Consultant or the Consultant’s Consultants, partners, joint venturers, subcontractors, officers, agents or employees acting under or pursuant to this Contract or any supplement or amendment hereto.

CLAIMS FOR OTHER THAN PROFESSIONAL LIABILITY. To the furthest extent permitted by Oregon law, Consultant shall indemnify, defend, indemnifysave, and hold harmless the District Agency, State of Oregon, the OTC and its ODOT, and their respective officers, agentsmembers, agents and employees from any and against all claims, suits, actions, losses, liabilities, damages, liabilities, costs and expenses expenses, including attorney fees, of whatsoever nature nature, resulting from, from or arising out ofof the acts or omissions of Consultant or its subcontractors, or relating to the activities of the Consultant or the Consultant’s Consultants, partners, joint venturers, subcontractors, officers, their respective agents or employees acting employees, under or pursuant to this Contract or any supplement or amendment heretothe Contract.
