Claims Services. a. TCG will not commence the Claims Services and process Your Claim(s) until TCG receives Your Instruction. b. i. You directly and will deal promptly with requests by Fast PPI for authority, information, documents or further requests that Fast PPI might make. You also give us permission to do a Credit Search on you for any Financial Related Products / Services you may have with a Credit Reference Agency.
j. You will inform TCG Fast PPI promptly of this and any relevant matters affecting Your the Claim(s), such as direct contact from the Company.
i. TCG k. Fast PPI will use reasonable endeavours to obtain Compensation for the Claim(s) pursued.

l. You agree to TCG dealing exclusively with pursue Your Claim(s) and acknowledge cancel this Agreement under clause 5.
m. Fast PPI will notify You of the outcome of the Claim(s).
n. If the Claim(s) is successful for Compensation for a PPI policy, the policy will be cancelled and You are responsible for identifying a replacement policy if appropriate.
o. Where we have identified, you are under an IVA or other debt arrangement and we have decided to claim against the lender on your behalf, then any compensation you may receive from the lender may offset against your debt. Please speak to your IVA on this matter.
p. Where interest is included as part of the Compensation it will be taxable depending on Your personal tax status.
q. If Fast PPI have not been made aware of all situations, Fast PPI will not be liable to You whether in contract or tort for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by You and by us, such as loss of profits or loss of opportunity.
r. You will not be liable for any Fees or charges if the Claim(s) is pursued and the Company pays no Compensation except where this Agreement is cancelled in accordance with clause 5, in which case a cancellation charge may be payable.
s. Fast PPI reserves the right to assign the Contract and all rights under it to a third party, provided that You could complain directly the party it assigns to undertakes to perform the contract in the manner set out in this agreement, and the Company may sub- contract to others all or any of its obligations. We will notify you 14 days prior to doing this and you will have the option to opt out during this time. The Contract is personal to the Client and is not assignable except to the personal representatives of the Client, save for a Claims representative appointed by the Company and/or to handle the FSCS andClients Claims a person who is not a party to the Contract will have no rights pursuant to the Contracts (Rights of Third Parties Act 1999) to enforce the Contract.
t. Fast PPI’s total liability to You in respect of all other losses arising under or in connection with this Agreement, if unsuccessfulwhether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the FOSamount of any Compensation to which You are entitled for the Claim(s) in connection to which Fast PPI is liable unless those losses were foreseeable by both parties when the Agreement was signed.
u. Nothing in this Agreement shall limit or exclude Fast PPI ‘s liability for: • death or personal injury caused by its negligence, at no costor the negligence of its employees, agents or subcontractors; • fraud or fraudulent misrepresentation; or • breach of the terms implied by sections 49 to 52 of the Consumer Rights Xxx 0000.

TCG will review and, if appropriate, based on the information provided by You and the Company, prepare, submit and handle issue You with a Legal Pack requesting Your Instruction to refer Your Claim(s) to the Company and/or Legal Partner to continue with the FOS and/or the FSCS Claim(s) on Your behalf. If TCG does not believe there is merit for Your Claim(s) TCG will notify You and provide information about Your next steps.

h. The Company may contact You directly and You will inform TCG promptly of this and any relevant matters affecting Your Claim(s).
i. TCG will use reasonable endeavours to obtain Compensation for the Claim(s) pursued.
j. TCG will update You about any significant development in Your Claim(s) using Your preferred contact method, including by SMS (text message), email, telephone and/or post. You will receive at least one update per Claim(s) every six months.
k. Any successful Claim(s) will be subject to a Fee(s), as set out in clause 4.
l. You agree to TCG dealing exclusively with post until Your Claim(s) and acknowledge that You could complain directly is referred to the Company and/or the FSCS and, if unsuccessful, the FOS, at no costLegal Partner.

Claims Services. a. TCG will not commence the Claims Services and process Your Claim(s) until TCG receives Your Instruction.
b. TCG will investigate use reasonable endeavours to request the Company provide information about any PPI policies and undisclosed commissions (Plevin) or other sums paid by the Company to third parties, that existed on any account(s) which You held with them, by making a SAR.
c. TCG will promptly notify You of the outcome of the Plevin Check(s).
d. If TCG are unable to identify a PPI policy(ies) and any undisclosed commissions (Plevin), or other sums paid by the Company to third parties, this Agreement will come to an end.
e. You authorise this Agreement to continue and for TCG to send You a Legal Pack(s) for any account(s) where a Company has confirmed You may have/had PPI and there were any undisclosed commissions (Plevin), or other sums paid by the Company to third parties associated with Your PPI policy(ies).
f. You understand that by completing one LOA, the Company may provide information about multiple PPI policies, under the Instruction(s) provided, and that TCG will review this information to identify potential Claim(s).
g. TCG will review and, if appropriate, based on the information provided by You and the Company, prepare, submit and handle issue You with a Legal Pack requesting Your Instruction to refer Your Claim(s) to the Company and/or Legal Partner to continue with the FOS and/or the FSCS Claim(s) on Your behalf. If TCG does not believe there is merit for Your Claim(s) TCG will notify You and provide information about Your next steps.
c. You understand that by completing and signing one LOA, that the Company may investigate all accounts held with them under the Instruction provided, and that any successful Claim(s) will be subject to a Fee(s).
d. You may also be asked to complete a FOS/PBA Questionnaire to allow TCG to investigate the existence and merits of the Claim(s).
e. h. TCG or the Company may require further authority, information or documents from You to facilitate the provision of the Claims Services. Documentation that may be required includes: includes proof of identification and proof of address (this is not an exhaustive list).
f. i. You agree that You will deal promptly with requests for authority, information or documents that TCG or the Company might make.
g. j. You will ensure that any information provided is true, accurate and completed to the best of Your knowledge. TCG will not check such information except where it is under legal obligation to do so.
h. The Company may contact k. You directly do not need to use a claims management company to assess Your eligibility for a Plevin Claim(s). You are free to seek advice elsewhere and You will inform TCG promptly of this and any relevant matters affecting are able to proceed with Your Claim(s)) directly through an alternate solicitor.
i. TCG will use reasonable endeavours to obtain Compensation for the Claim(s) pursued.
j. l. TCG will update You about any significant development in Your Claim(s) using Your preferred contact method, including by SMS (text message), email, telephone and/or postpost until Your Claim(s) is referred to the Legal Partner. You will receive at least one update per Claim(s) every six monthssixty days.
k. Any successful Claim(s) will be subject to a Fee(s), as set out in clause 4.
l. You agree to TCG dealing exclusively with Your Claim(s) and acknowledge that You could complain directly to the Company and/or the FSCS and, if unsuccessful, the FOS, at no cost.
