Common use of Claims Services Clause in Contracts

Claims Services. a. Wellbeing Services Limited will not commence the Claims Services and process Your Claim(s) until Wellbeing Services Limited receives Your Instruction. b. Wellbeing Services Limited will use reasonable endeavours to request the Loan / Credit Card Provider confirms whether You held a Loan(s) / Credit Card(s) with them, by making a SAR. c. If no Loan(s) / Credit Card(s) is identified, this Agreement will come to an end. d. You authorise this Agreement to continue on any Loan(s) / Credit Card(s) that has been identified by Your Loan / Credit Card Provider. e. Wellbeing Services Limited will investigate and, if appropriate, based on the information provided by You and the Loan / Credit Card Provider, prepare, submit and handle Your Claim(s) to the Loan / Credit Card Provider and/or the FOS on Your behalf. If Wellbeing Services Limited does not believe there is merit for Your Claim(s) Wellbeing Services Limited will notify You and provide information about Your next steps. f. You understand that by completing and signing one LOA, the Loan / Credit Card Provider may investigate all Loan(s) / Credit Card(s) held with them under the Instruction provided, and that any successful Claim(s) will be subject to a Fee(s). g. Wellbeing Services Limited will use reasonable endeavours to obtain Compensation for the Claim(s) pursued. h. Wellbeing Services Limited will update You about any significant development in Your Claim(s) using Your preferred contact method, including by email, telephone and/or post. You will receive at least one update per Claim(s) every six months.

Claims Services. a. Wellbeing Services Limited We will not commence process the Claims Services and process Your Claim(s) until Wellbeing Services Limited receives We receive Your Instruction. b. Wellbeing Services Limited will use reasonable endeavours You understand that by providing Your Instructions to request Us You are providing authority for Us to identify all Credit Products You have held with Xxxxxxx since 2008 and make a Claim(s) against the Loan / Credit Card Provider confirms whether You held a Loan(s) / Credit Card(s) with themrelevant Lenders on your behalf, by making a SAR. c. If no Loan(s) / Credit Card(s) is identified, this Agreement will come to an end. d. You authorise this Agreement to continue on any Loan(s) / Credit Card(s) that has been identified by Your Loan / Credit Card Provider. e. Wellbeing Services Limited will investigate and, if appropriate, based on the information provided by You and the Loan / Credit Card Provider, prepare, submit and handle including submitting Your Claim(s) to FOS, where We identify that such Claim(s) has a reasonable prospect of success. c. Upon receiving Your Instruction We may undertake the Loan / Soft Credit Card Provider Check to identify which Lenders you held Credit Products with and information about the Credit Products, including account numbers. d. Once we identify Your Lenders and Credit Products, we will: (i) submit a Claim(s) to the Lenders, or the FSCS, where We have all relevant information to do so and believe the Claim(s) has a reasonable prospect of success; and/or the FOS on Your behalf. If Wellbeing Services Limited does not believe there is merit for (ii) where required, request additional information from You to substantiate Your Claim(s) Wellbeing Services Limited will notify against Your Lenders; and/or (iii) where required, request information from the Lenders or other relevant third parties about the Credit Products You and provide information about held. You consent for your signature, where applicable, to be used to submit Your next stepscomplaint to a Lender or to the FOS. f. You understand that by completing and signing one LOA, the Loan / Credit Card Provider may investigate all Loan(s) / Credit Card(s) held with them under the Instruction provided, and that any successful Claim(s) will be subject to a Fee(s). g. Wellbeing Services Limited e. We will use reasonable endeavours to obtain Compensation for each Claim pursued and will liaise and negotiate with the Lender on Your behalf, as necessary to progress the Claim(s). f. Where Your Lender does not provide a satisfactory outcome to Your Claim(s), We will assess Your Claim(s) and submit the Claim(s) pursuedto FOS where there is merit to do so. g. We will keep You updated throughout the Claim(s) and promptly notify You of the outcome of the Claim(s). h. Wellbeing We may outsource some elements of the Claims Services Limited will update such as the administration of the Claim(s), taking and making of telephone calls and/or chasing documents from You about any significant development in Your to a specialist supervised Company(ies). You agree for Us to outsource elements of the Claim(s) using and pay a fee for doing so. For the avoidance of doubt any fees will be paid directly by Us and are not charged to you. i. Where interest is included by the Lender as part of the Compensation, they may deduct tax from this and pay it directly to HMRC. Depending on Your preferred contact method, including by email, telephone and/or postpersonal tax status this tax may be refundable. Where You will receive at least one update per have a successful Claim(s) every six monthsWe may contact You at the conclusion of the Claim(s) to assist You in claiming a tax refund, where this is due to You. x. Xxxxxxxxxx Xxxxx Ltd have referred your claim to us and we will pay them a fee for doing so. k. By signing the Agreement You provide Your consent for Your signature to be applied to all documentation necessary to investigate and submit Your claims based on the information given. This includes any other Lenders You have informed us about when submitting Your claim.
