Common use of Claims Services Clause in Contracts

Claims Services. a. TCG will not commence the Claims Services until TCG receives Your Instruction. b. TCG will use reasonable endeavours to complete the Plevin PPI Check(s) and identify whether You have a Plevin PPI Claim(s). c. As part of the Plevin PPI Check(s) TCG may request the Company provide information about any PPI policy(ies) and undisclosed commissions earned by the Company, or other sums paid by the Company to third parties, that existed on any account(s) which You held with them, by making a DSAR. d. By signing the LOA for TCG Legal, You provide Instruction for TCG Legal to support TCG in completing the Plevin PPI Check(s). As part of the Plevin PPI Check(s), TCG Legal may make a DSAR, or other such request, to the Company. e. If TCG or TCG Legal are unable to identify a PPI policy(ies) and any undisclosed commissions earned by the Company, or other sums paid by the Company to third parties, this Agreement will come to an end. f. You authorise this Agreement to continue and for TCG to send You a Legal Pack(s) for any account(s) where We believe You have a potential Plevin PPI Claim(s). g. You understand that by completing the LOAs, you provide authorisation for the Company to provide information to TCG and/or TCG Legal about all PPI policies you held with the Company and that this information will be reviewed to identify potential Plevin PPI Claim(s). h. TCG will review the information provided by You and the Company, and if appropriate, issue You with a Legal Pack(s) containing further information about TCG Legal. i. You agree that You will deal promptly with requests for authority, information or documents that TCG or the Company might make. j. You will ensure that any information provided is true, accurate and completed to the best of Your knowledge. TCG will not check such information except where it is under legal obligation to do so. k. You do not need to use a claims management company to assess Your eligibility for a Plevin PPI Claim(s). You are free to seek advice elsewhere and are able to proceed with Your Plevin PPI Claim(s) directly through an alternate solicitor.

TCG will promptly notify You of the outcome of the PPI Check(s). d. By signing the LOA for TCG Legal, You provide Instruction for TCG Legal to support TCG in completing the Plevin PPI Check(s). As part of the Plevin PPI Check(s), TCG Legal may make a DSAR, or other such request, to the Company. e. If TCG or TCG Legal are unable to identify a PPI policy(ies) and any undisclosed commissions (Plevin) earned by the Company, or other sums paid by the Company to third parties, this Agreement will come to an end. f. e. You authorise this Agreement to continue and for TCG to send You a Legal Pack(s) for any account(s) where We believe a Company has confirmed You have a may have/ had PPI and there were any undisclosed commissions (Plevin) earned by the Company, or other sums paid by the Company to third parties associated with Your PPI policy(ies). f. You understand that by completing one LOA, the Company may provide information about multiple PPI policies, under the Instruction(s) provided, and that TCG will review this information to identify potential Plevin PPI Claim(s). g. You understand that by completing the LOAs, you provide authorisation for the Company to provide information to TCG and/or TCG Legal about all PPI policies you held with the Company and that this information will be reviewed to identify potential Plevin PPI Claim(s). h. TCG will review and, if appropriate, based on the information provided by You and the Company, and if appropriate, issue You with a Legal Pack(sPack requesting Your Instruction to refer Your Claim(s) containing further information about TCG Legalto the Legal Partner to continue with the Claim(s) on Your behalf. i. h. You agree that You will deal promptly with requests for authority, information or documents that TCG or the Company might make. j. i. You will ensure that any information provided is true, accurate and completed to the best of Your knowledge. TCG will not check such information except where it is under legal obligation to do so. k. j. You do not need to use a claims management company to assess Your eligibility for a Plevin PPI Claim(s). You are free to seek advice elsewhere and are able to proceed with Your Plevin PPI Claim(s) directly through an alternate solicitor.

If TCG or TCG Legal are unable to identify a PPI policy(ies) and any undisclosed commissions earned by the Company, or other sums paid by the Company to third parties, this Agreement will come to an end. f. e. You authorise this Agreement to continue and for TCG to send You a Legal Pack(s) for any account(s) where We believe a Company has confirmed You have a potential Plevin may have/had PPI Claim(sand there were any undisclosed commissions earned by the Company, or other sums paid by the Company to third parties associated with Your PPI policy(ies). g. f. You understand that by completing the LOAsone LOA, you provide authorisation for the Company to may provide information to TCG and/or TCG Legal about all multiple PPI policies you held with policies, under the Company Instruction(s) provided, and that TCG will review this information will be reviewed to identify potential Plevin PPI Claim(s). h. g. TCG will review and if appropriate, based on the information provided by You and the Company, and if appropriate, issue You with a Legal Pack(s) Pack containing further information about TCG Legalthe Legal Partner and a copy of their Agreement to Proceed. By completing the Agreement to Proceed You to provide Instruction for the Legal Partner to proceed with a Plevin PPI Claim(s) on your behalf. i. h. You agree that You will deal promptly with requests for authority, information or documents that TCG or the Company might make. j. i. You will ensure that any information provided is true, accurate and completed to the best of Your knowledge. TCG will not check such information except where it is under legal obligation to do so. k. j. You do not need to use a claims management company to assess Your eligibility for a Plevin PPI Claim(s). You are free to seek advice elsewhere and are able to proceed with Your Plevin PPI Claim(s) directly through an alternate solicitor.

Claims Services. a. TCG Legal will not commence the Claims Services until TCG receives process Your InstructionClaim(s) un�l We receive Your Instruc�ons. b. TCG will use reasonable endeavours You acknowledge that You could complain directly to complete the Plevin PPI Check(s) and identify whether Company Yourself or with the assistance of any legal expenses insurance that You have a Plevin PPI Claim(s)may have, with the ability to take ma�ers further to the FOS, FSCS or Court. c. As part of If You do not instruct TCG Legal in wri�ng but instruct TCG Legal over the Plevin PPI Check(s) TCG may request the Company provide information about any PPI policy(ies) and undisclosed commissions earned telephone, You will s�ll be bound by the Company, or other sums paid by the Company Agreement to third parties, that existed on any account(s) which You held with them, by making a DSARProceed. d. By signing giving Your Instruc�ons to TCG Legal You acknowledge that You are gran�ng TCG Legal the LOA for exclusive right to deal with the Claim(s), unless otherwise agreed in wri�ng by You and TCG Legal. e. Before TCG Legal can act for You, We are required by law to verify Your iden�ty(ies) and address(es). By giving Your Instruc�ons You provide Instruction for acknowledge that You are giving consent to TCG Legal to support TCG undertake an electronic iden�ty check. This process involves searches with a credit reference and fraud preven�on agencies and the electoral register. The agencies will record the details of the search whether or not Your Claim proceeds. Banks and other organisa�ons may share these searches in completing the Plevin PPI Check(s)order to prevent fraud. As Scoring methods may be used as part of the Plevin PPI Check(s), this process. The electronic checks that TCG Legal may will make a DSAR, or other such request, will have no adverse affect on Your credit ra�ng. You agree to the Company. e. If TCG or assist TCG Legal with any further due diligence checks it considers are unable necessary to identify a PPI policy(ies) comply with its regulatory obliga�ons to combat money laundering and any undisclosed commissions earned by the Company, or other sums paid by the Company to third parties, this Agreement will come to an endcriminal ac�vity. f. You authorise this Agreement understand that by issuing Your Instruc�ons, that the Company may inves�gate all Claim(s) under the Instruc�ons and that any successful Claim(s) will be subject to continue and for TCG to send You a Legal Pack(sFee(s) for any account(s) where We believe You have a potential Plevin PPI Claim(s)plus VAT, as set out in clause 3. g. You understand that by completing the LOAs, you provide authorisation for the Company may be asked to provide information all relevant informa�on in rela�on to TCG and/or TCG Legal about all PPI policies you held with the Company Claim(s) that You have in Your possession. You will ensure that any informa�on provided is accurate and that this information will be reviewed true to identify potential Plevin PPI Claim(s)the best of Your knowledge. h. TCG will review the information provided by You and the Company, and if appropriate, issue You with a Legal Pack(s) containing further information about TCG Legal. i. You agree that You will deal promptly with requests by TCG Legal for authority, information informa�on, documents or further requests. i. Where We believe that poten�al Mis-selling has occurred to You, We will submit a detailed Claim to the Company and/or the Court upon Your Instruc�ons. j. TCG Legal will use reasonable endeavours to keep safe any informa�on or documents that TCG or the Company might make. j. You will ensure that any information provided is true, accurate and completed send to the best of Your knowledgeUs. TCG Legal will not check such information except where it is under legal obligation be responsible for any loss to do soYou or any third party arising out of the loss of documents or informa�on including in transit either to or from TCG Legal. Any addi�onal protec�on that You require for lost documenta�on or informa�on (for example photocopies and/or a Recorded Delivery service by Royal Mail) will be at Your discre�on and Your expense. k. You do will inform TCG Legal promptly of any relevant ma�ers affec�ng the Claim(s), such as direct contact from the Company. l. TCG Legal will use reasonable endeavours to obtain Compensa�on for the Claim(s) pursued. m. TCG Legal will promptly no�fy You if TCG Legal decides not need to use pursue Your Claim(s) and cancel any Agreement to Proceed. This decision shall remain in TCG Legal’s absolute discre�on. n. TCG Legal will promptly no�fy You of the outcome of the Claim(s). o. Your Compensa�on may be applied as part of Your bankruptcy estate, insolvency asset, or other debt arrangement and Your Compensa�on may not be paid directly to You. p. Where interest is included by the Company as part of the Compensa�on it may be taxable depending on Your personal tax status and You understand that You may be required to disclose this payment to HMRC. TCG Legal will not give any advice to You in rela�on to tax. q. Any Compensa�on paid directly to TCG Legal will be held on Your behalf in a claims management company client account. TCG Legal will normally account to assess You for any interest on balances held on Your eligibility behalf in TCG Legal’s client account at the conclusion of a ma�er. Interest will be paid only where the amount of interest calculated exceeds £20. Please contact TCG Legal for a Plevin PPI Claim(scopy of the firm’s policy on monies held in client account. r. TCG Legal will not be liable to You whether in contract or tort for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by You and by Us, such as (but not limited to) loss of profits, loss of opportunity, loss of benefits or tax demands. s. TCG Legal reserves the right to assign the Agreement to Proceed and all rights under it and to subcontract to others all or any of Our obliga�ons under it. The Agreement to Proceed is personal to You and is not assignable by You except to Your personal representa�ves. t. TCG Legal’s total liability to You in respect of all other losses arising under or in connec�on with the Agreement to Proceed, whether in contract, tort (including negligence). , breach of statutory duty, or otherwise, shall in no circumstances exceed the amount of any Compensa�on to which You are free to seek advice elsewhere and are able to proceed with Your Plevin PPI en�tled for the Claim(s) directly through an alternate solicitorin connec�on to which TCG Legal is liable unless those losses were foreseeable by both par�es when the Agreement to Proceed was signed. We consider that this limit is reasonable and fair in view of the type of work that We are undertaking. If the limit does cause You any concern, please contact Us so that We can discuss Your concerns. u. Nothing in the Agreement to Proceed shall limit or exclude TCG Legal’s liability for: • death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors; • fraud or fraudulent misrepresenta�on; or • breach of the terms implied by sec�ons 49 to 52 of the Consumer Rights Act 2015.

Xxxxxxxxx will promptly notify You of the outcome of the PPI Check(s). d. By signing the LOA for TCG Legal, You provide Instruction for TCG Legal to support TCG in completing the Plevin PPI Check(s). As part of the Plevin PPI Check(s), TCG Legal may make a DSAR, or other such request, to the Company. e. If TCG or TCG Legal Xxxxxxxxx are unable to identify a PPI policy(ies) and any undisclosed commissions earned by the Company, or other sums paid by the Company to third parties, this Agreement will come to an end. f. e. You authorise this Agreement to continue and for TCG Xxxxxxxxx to send You a Legal Pack(s) for any account(s) where We we believe You you have a potential Plevin PPI Claim(s). g. f. You understand that by completing the LOAsone LOA, you provide authorisation for the Company to may provide information to TCG and/or TCG Legal about all multiple PPI policies you held with policies, under the Company Instruction(s) provided, and that Xxxxxxxxx will review this information will be reviewed to identify potential Plevin PPI Claim(s). h. TCG x. Xxxxxxxxx will review the information provided by You and the Company, and if appropriate, issue You with a Legal Pack(s) Pack containing further information about TCG Legala Legal Partner and a copy of their Instruction Document. By completing the Instruction Document You provide Instruction for the Legal Partner to proceed with a Plevin PPI Claim(s) on your behalf. i. h. You agree that You will deal promptly with requests for authority, information or documents that TCG Xxxxxxxxx or the Company might make. j. i. You will ensure that any information provided is true, accurate and completed to the best of Your knowledge. TCG Xxxxxxxxx will not check such information except where it is under legal obligation to do so. k. j. You do not need to use a claims management company to assess Your eligibility for a Plevin PPI Claim(s). You are free to seek advice elsewhere and are able to proceed with Your Plevin PPI Claim(s) directly through an alternate solicitor.
