Class Representative Enhancement Payment Clause Samples
A Class Representative Enhancement Payment clause provides for additional compensation to the individual(s) who serve as class representatives in a class action lawsuit. This payment is typically awarded in recognition of the time, effort, and potential risks the representative undertakes on behalf of the class, such as participating in depositions or assisting with case preparation. The core function of this clause is to incentivize individuals to take on the responsibilities of representing the class and to fairly compensate them for their unique contributions beyond those of other class members.
Class Representative Enhancement Payment. The amount the Court awards to Plaintiff for his services as Class Representative, which will not exceed $10,000. This payment shall be paid from the Qualified Settlement Fund and will not be opposed by Defendant. This enhancement payment is subject to approval of the Court. If the Court awards less than the amount requested, any amount not awarded will become part of the Net Settlement Amount for distribution to Participating Class Members.
Class Representative Enhancement Payment. Defendant will not object to a request for a Class Representative Enhancement Payment of up to $5,000.00 for the Class Representative’s Enhancement Payment for her time and risks in prosecuting this case and her service to the Settlement Class. This award will be in addition to Plaintiff’s Individual Settlement Payment as a Settlement Class Member, and shall be reported on an IRS Form 1099 by the Claims Administrator.
Class Representative Enhancement Payment. The amount the Court awards to Plaintiff, which will not exceed $7,500. This payment shall be paid from the Gross Settlement Amount. This payment is being offered in consideration for Plaintiff executing a general release of claims against Defendant, a release that is broader than any Participating Class Member will provide in consideration for a settlement share. This payment is also offered in consideration for the Plaintiff’s actions in conferring a benefit upon the State of California and the Class, and the time and effort Plaintiff put into pursuing the litigation. If the Court awards less than the amount requested, any amount not awarded will become part of the Net Settlement Amount for distribution to Participating Class Members.
Class Representative Enhancement Payment. In exchange for general releases, and in recognition of his effort and work in prosecuting the Action on behalf of Class Members, Defendant agrees not to oppose or impede any application or motion for a Class Representative Enhancement Payment of ($10,000.00) to Plaintiff for his services on behalf of the Settlement Class. The Class Representative Enhancement Payment will be paid from the Class Settlement Amount and will be in addition to Plaintiff’s individual settlement payment paid pursuant to the Settlement. Plaintiff will be solely and legally responsible to pay any and all applicable taxes on the payments made pursuant to this paragraph and will indemnify and hold Defendant harmless from any claim or liability for taxes, penalties, or interest arising as a result of the payment.
Class Representative Enhancement Payment. Defendant will not object to a request for a Class Representative Enhancement Payment of up to $10,000.00 for each Class Representative’s Enhancement Payment (total up to $20,000.00) for their time and risks in prosecuting this case and their service to the Settlement Class. This award will be in addition to Plaintiffs’ Individual Settlement Payment as a Settlement Class Member, and shall be reported on an IRS Form 1099 by the Claims Administrator.
A. Within 14 calendar days following the deposit of the first installment payment with the Claims Administrator as set forth in Section 3.B.(1) herein, the Claims Administrator will deliver/transfer the Class Representative Enhancement Payments to Plaintiffs.
Class Representative Enhancement Payment. Defendant will not object to a request for a Class Representative Enhancement Payment of up to $10,000.00 for Class Representative’s Enhancement Payment for his time and risks in prosecuting this case and his service to the Settlement Class. This award will be in addition to Plaintiff’s Individual Settlement Payment as a Settlement Class Member, and shall be reported on an IRS Form 1099 by the Claims Administrator.

Class Representative Enhancement Payment. The amount the Court awards to Plaintiff ▇▇▇▇▇▇▇ ▇▇▇▇▇▇▇▇▇ for her effort and work in prosecuting the Litigation on behalf of all Class Members and paid by Defendant in exchange for the Class Representative’s general release of claims, which shall not exceed Seven Thousand Five Hundred Dollars and Zero Cents ($7,500.00). This payment shall be paid from the Qualified Settlement Fund. Defendant will not oppose Plaintiff’s request for a Class Representative Enhancement Payment in an amount not to exceed Seven Thousand Five Hundred Dollars and Zero Cents ($7,500.00). The Class Representative Enhancement Payment is subject to approval of the Court. If the Court awards less than the amount requested, any amounts not awarded will be part of the Net Settlement Amount (as defined in Section I.20).
Class Representative Enhancement Payment. Defendant will not object to a request for a Class Representative Enhancement Payment of up to $8,500 to Plaintiff for her time and efforts in prosecuting the Action. This award will be in addition to Plaintiff’s Individual Settlement Payment and Individual PAGA Payment, and shall be reported on an IRS Form 1099 by the Settlement Administrator. If the Court approves less than the amount requested for the Class Representative Enhancement Payment, the difference between the requested and awarded amounts will be included in the Net Settlement Amount and distributed pro rata to the Settlement Class Members as set forth in Section 5.B.
Class Representative Enhancement Payment. Defendants agree not to oppose or object to any application or motion by Plaintiff for a Class Representative Enhancement Payment up to Seven Thousand Five Hundred Dollars ($7,500) for Plaintiff ▇▇▇▇▇▇ ▇▇▇▇▇ ▇▇▇▇▇▇▇. The Class Representative Enhancement Payment is in exchange for the General Release of the Any portion of the requested Class Representative Enhancement Payment that is not awarded to the Class Representative shall be reallocated to the Net Settlement Amount and distributed to Participating Class Members as provided in this Agreement.

This payment shall be paid from the Qualified Settlement Fund. Defendant will not oppose Plaintiffs’ request for a Class Representative Enhancement Payment, which shall be subject to approval of the Court. If the Court awards less than the amount requested, the Net Settlement Amount shall be recalculated to reflect the actual Class Representative Enhancement Payment, and shall not be a reason to invalidate or terminate this Agreement.
