CLASS SETTLEMENT TERMS. 4.1. Class Notice Plan 4.1.1. Court Appointment and Retention of Settlement Administrator At the Preliminary Approval hearing, the Parties will propose that the Court appoint the Settlement Administrator, as defined above. The Settlement Administrator’s responsibilities shall include, but are not limited to, giving notice, obtaining new addresses for returned mail, setting up and maintaining a Settlement Website and toll-free telephone number, fielding inquiries about the Settlement Agreement, directing the mailing of payments to Class Members, and any other tasks reasonably required to effectuate Settlement. The Settlement Administrator will provide monthly updates to counsel for the Parties on the status of the mailing of the Class Notice and the distribution and redemption of payments to Class Members.
