CLASSIFICATION DISPUTES PROCEDURE. Where there is a disagreement about the appropriate classification of an employee the following procedure shall apply: (a) An employee representative where appointed by the employee consistent with clause 17.1.1 (a) shall be notified and the matter discussed between management and the employee representative and the affected employee. (b) For existing employees reference may be made to the Metal, Engineering and Related Services competency standard unit covering the particular skill in the definition which is in dispute. For new employees reference shall be made to the Metal, Engineering and Related Services Training Package, the example pathways and the Competency Standards Implementation Guide. (c) Where this does not resolve the issue an assessment process may be agreed in respect to the unit of competency which is in dispute. Such assessment process must involve a qualified workplace assessor who meets the requirements for workplace assessor as set out in the Metal, Engineering and Related Services Training Package and the Competency Standards Implementation Guide. (d) Where this does not resolve the issue the matter may be referred to a representative or expert nominated by the employee and a representative or expert nominated by the employer. The principles set out in Metal, Engineering and Related Service Training Package and the Competency Standards Implementation Guide shall be utilised. If their recommendation does not resolve the issue then the matter may be referred to the AIRC, consistent with Clause 17.

(b) Where this does not resolve the issue, an assessment process may be agreed in respect to the competency which is in dispute. Such assessment process must involve a qualified workplace assessor. (c) Where this does not resolve the issue the matter may be referred to a senior official or expert nominated by each party. The principles set out in the Laboratory Operations Training Package (PM L04) or other relevant National Training Package and the Metal and Engineering Industry Competency Standards Implementation Guide shall be utilised. If their recommendation does not resolve the issue then the matter may be referred to an agreed arbitrator under the Dispute Settlement Procedure in this Agreement.

Such assessment process must involve an appropriately qualified technical assessor who meets the requirements for a technical assessor. c) Further advice may be sort from an agreed expert. If their recommendation does not resolve the issue then the matter may be referred to the Fair Work Commission. Where Qualifications and Units of competence under the Australian Qualifications Framework apply then the principles set out by Manufacturing Skills Australia and the National Metal and Engineering Competency Standards Implementation Guide shall be utilised.
