ANNUAL LEAVE Entitlement to annual leave. 4.1 An employee, other than a casual employee, is entitled to accrue an amount of paid annual leave, for each completed 4 week period of continuous service with the Company, of 1 / 13 of the number of nominal hours worked by the employee during that 4 week period. ANNUAL LEAVE Entitlement to annual leave. 8.1 Full time employees are entitled to twenty (20) days paid annual leave per year in accordance with the Workplace Relations Xxx 0000 Part time employees are entitled to leave on a pro rata basis.
ANNUAL LEAVE Entitlement to annual leave. In accordance with the Australian Fair Pay and Conditions Standard, an Employee is entitled to an amount of paid annual leave, for each completed four week period of continuous service with the Company, of 1/13th of the number of nominal hours worked by the employee during that four week period. Example: If the employee’s nominal hours worked for a 12 month period were 38 hours per week, the employee would be entitled to 152 hours of annual leave (which would be the equivalent of four weeks of annual leave if his or her nominal hours worked remained unchanged). Note: Annual leave will not accrue in respect of hours worked above 38 hours per week. This means that the maximum amount of annual leave which can accrue per annum is 152 hours. Time of Taking Annual Leave Annual leave is to be taken at a time that suits both parties. If an Employee’s accrued leave exceeds 8 weeks, the Company may direct the employee to take up to 2 weeks leave at a time that suits the business. The Company may also direct the employee to take any leave that has accrued prior to 27 March 2006 at a time that suits our business. The Company may direct the employee to take accrued annual leave during any annual shut down or due to shortage of work. If the employee does not have sufficient accrued leave the Company may, at the Company’s discretion, direct the employee to take unpaid leave or leave in advance of the accrual. Cashing out Annual Leave The Employee may, with the agreement of the Company, request to cash out up to 2 weeks annual leave within a 12 month period. Cashed out annual leave will be paid at the rate of pay that the employee receives at the time when the election is made. In making this election, the Employee gives up his/her entitlement to take that amount of annual leave and the Company will deduct the amount of annual leave cashed out from the employee’s accumulated annual leave balance. Annual Leave Pay rate During periods of annual leave, the Employee will be paid the wages s/he would have received in respect of the ordinary time s/he would have worked had s/he not been on leave during the relevant period.

  • Payment of Annual Leave (a) If an employee takes annual leave during a period, the annual leave shall be paid at the employee’s ordinary pay immediately before the period begins.

  • Entitlement to Leave An employee shall be granted Workers' Compensation leave with pay in the event that the Workers' Compensation Board (WorkSafe BC) determines that the employee has established a claim (time loss benefits) and they are unable to perform their duties by reason of the compensable injury which occurred while employed by the Employer. For the purposes of this clause, pay is defined as the employee's regular take-home wages to ensure that the non-taxable status of Workers' Compensation benefits does not provide an opportunity for an injured worker to earn more while on claim than if they were working. The term claim will not include any form of WCB allowance or pension, and this section will not be operative while an employee is receiving such a different form of payment from WCB arising from this claim.

  • Taking Annual Leave (1) An employee may, on application approved by the Secretary, take annual leave in either of the following ways:

  • Entitlement to Vacation Leave With Pay An employee is entitled to vacation leave with pay to the extent of his or her earned credits but an employee who has completed six (6) months of continuous employment may receive an advance of credits equivalent to the anticipated credits for the vacation year.

  • Annual Leave Accrual If an employee leaves State Classified employment and is later rehired, he/she shall accrue annual leave at the same rate as a new hire. However, once a rehired employee has been in pay status for five (5) years, all previous service time shall be credited for annual leave accrual. The only exception shall be for employees rehired who repay severance pay received.
