ANNUAL LEAVE Entitlement to annual leave. 4.1 An employee, other than a casual employee, is entitled to accrue an amount of paid annual leave, for each completed 4 week period of continuous service with the Company, of 1 / 13 of the number of nominal hours worked by the employee during that 4 week period. Example: An employee whose nominal hours worked for a 4 month period were 38 hours per week would be entitled to 152 hours of annual leave (which would be the equivalent of 4 weeks of annual leave if his or her nominal hours worked remained unchanged). Additional leave entitlement for shift workers 4.2 An employee is also entitled to accrue an amount of paid annual leave, for each completed 4 month period of continuous service, of 1 / 52 of the number of nominal hours worked by the employee as a 7 day shift worker during that 4 month period. Example: A shift worker whose nominal hours worked for a 4 month period were 38 hours per week, and who worked as a 7 day shift worker throughout that period, would be entitled to an additional 38 hours of annual leave (which would be the equivalent of one week of annual leave if his or her nominal hours worked remained unchanged).

ANNUAL LEAVE Entitlement to annual leave. 8.1 Full time employees are entitled to twenty (20) days paid annual leave per year in accordance with the Workplace Relations Xxx 0000 Part time employees are entitled to leave on a pro rata basis. 8.2 Annual leave entitlements accumulate from year to year and will be paid out on termination on a pro rata basis. 8.3 Accrued annual leave must be taken at a mutually convenient time as agreed between EGT, the Host Employer (as applicable) and the Employee. 8.4 An EGT Leave Application Form must be completed and approved at least one (1) month prior to the commencement of leave. 8.5 Annual leave may be taken, with the agreement of EGT, in periods of one (1) working day or less. 8.6 EGT may direct employees to take accrued annual leave during periods of downturn or lower than usual activity. 8.7 Employees may be required to take accrued annual leave during EGT’s or a Host Employer’s (as applicable) Christmas shutdown period in accordance with the Workplace Relations Xxx 0000. The Host Employer will notify the employee of the intended dates of the Christmas shutdown period. 8.8 EGT may direct an employee to take an amount of excessive accrued annual leave in accordance with section 236(6) of the Workplace Relations Xxx 0000.
ANNUAL LEAVE Entitlement to annual leave. 72.1 Full time employees (other than casual employees) are entitled to: (a) in the case of 36.75 hour workers, 147 hours annual leave, for each full year worked; or (b) in the case of 38 hour workers, 152 hours annual leave, for each full year worked. 72.2 Where less than a full year is worked, employees are entitled to annual leave on a pro-rata basis. 72.3 Part-time employees will accrue a pro-rata credit based on the number of part-time hours worked. 72.4 Shift workers who are regularly rostered to work on Sunday and work at least ten Sundays in a year will be entitled to an additional five days of paid annual leave per year 72.5 Shift workers rostered to work on less than ten Sundays during which annual leave will accrue will be entitled to additional annual leave at the rate of one tenth of a working week for each Sunday so rostered. 72.6 Annual leave accrues on a daily basis, according to the formula set out below: (A x B x D) / C where A = Number of ordinary hours per week worked; B = One or zero (where the day does not count as service); C = Number of calendar days in the year; and D = Four (basic annual leave accrual of four weeks). 72.7 Unauthorized absence will not contribute to the annual leave credit. 72.8 Where any public holiday occurs for which the employee is entitled to payment, during any period of annual leave, the period of the holiday is not deducted from the annual leave entitlement. 72.9 An employee who is medically unfit for duty for one day or longer while on annual leave and who produces satisfactory medical evidence may apply for personal leave. In these circumstances, annual leave will be re-credited for the period of personal leave granted.
ANNUAL LEAVE Entitlement to annual leave. In accordance with the Australian Fair Pay and Conditions Standard, an Employee is entitled to an amount of paid annual leave, for each completed four week period of continuous service with the Company, of 1/13th of the number of nominal hours worked by the employee during that four week period. Example: If the employee’s nominal hours worked for a 12 month period were 38 hours per week, the employee would be entitled to 152 hours of annual leave (which would be the equivalent of four weeks of annual leave if his or her nominal hours worked remained unchanged). Note: Annual leave will not accrue in respect of hours worked above 38 hours per week. This means that the maximum amount of annual leave which can accrue per annum is 152 hours. Annual leave is to be taken at a time that suits both parties. If an Employee’s accrued leave exceeds 8 weeks, the Company may direct the employee to take up to 2 weeks leave at a time that suits the business. The Company may also direct the employee to take any leave that has accrued prior to 27 March 2006 at a time that suits our business. The Company may direct the employee to take accrued annual leave during any annual shut down or due to shortage of work. If the employee does not have sufficient accrued leave the Company may, at the Company’s discretion, direct the employee to take unpaid leave or leave in advance of the accrual. The Employee may, with the agreement of the Company, request to cash out up to 2 weeks annual leave within a 12 month period. Cashed out annual leave will be paid at the rate of pay that the employee receives at the time when the election is made. In making this election, the Employee gives up his/her entitlement to take that amount of annual leave and the Company will deduct the amount of annual leave cashed out from the employee’s accumulated annual leave balance. During periods of annual leave, the Employee will be paid the wages s/he would have received in respect of the ordinary time s/he would have worked had s/he not been on leave during the relevant period.

  • Entitlement to Annual Leave For each year of service with the Employer a full-time or part-time Employee is entitled to four (4) weeks of paid annual leave.

  • Annual Leave 17.1 An employee shall be entitled to four weeks annual leave for each twelve months’ service with the Company, exclusive of public holidays. Annual leave accumulates monthly on a pro rata basis. 17.2 The annual leave entitlement for each part time employee shall be calculated pro rata according to the ordinary hours he or she actually works. 17.3 The time of giving and taking of leave shall be by mutual arrangement between the Company and the employee concerned. 17.4 The Company may direct an employee to take annual leave during any shut down, including any such shut down over the Christmas and New Year period, provided the employee has an accrued annual leave balance that will at least cover the period of the shut down. 17.5 The Company may direct an employee to take up to a quarter of his or her total accrued annual leave entitlement if the employee’s accrued annual leave entitlement exceeds 8 weeks. 17.6 Payment for annual leave shall be made at the relevant minimum rate of pay in clause 19 – Minimum wages, plus a loading of 17.5 per cent on that rate of pay. 17.7 The Company may allow annual leave to be taken by an employee before the right thereto has accrued due. 17.8 An employee has no entitlement to the payment of the loading, when annual leave is taken wholly or partly in advance, until an entitlement accrues due and the loading is then payable in respect of the period of such leave and is calculated on the relevant minimum rate of pay in clause 19 – Minimum wages, payable at the accruing of the entitlement. 17.9 Where leave has been granted to an employee before the leave has accrued due, the Company may deduct the balance of the payment to the employee for that leave period from whatever remuneration is payable to him or her upon the cessation of employment. 17.10 An employee whose employment is terminated by the Company or who lawfully leaves the employment shall be entitled to a pro rata payment calculated on his or her relevant minimum rate of pay in clause 19 – Minimum wages, for the period in respect of which annual leave has not been taken, provided that the loading in clause 17.6 shall only be paid in respect of paid out annual leave for employees who have been employed for a minimum 12 months with the Company.

  • Payment of Annual Leave Upon resignation, retirement, or dismissal of any employee in the bargaining unit, he/she shall receive a sum equal to the number of days of annual leave remaining to his/her credit, provided that any or all amounts may be applied to offset any amounts owed the state by the employee. In the event of death of an employee while in the bargaining unit, a sum equal to the number of days annual leave remaining shall be paid to his/her estate.

  • Entitlement to Leave An employee shall be granted Workers' Compensation leave with pay in the event that the Workers' Compensation Board (WorkSafe BC) determines that the employee has established a claim (time loss benefits) and they are unable to perform their duties by reason of the compensable injury which occurred while employed by the Employer. For the purposes of this clause, pay is defined as the employee's regular take-home wages to ensure that the non-taxable status of Workers' Compensation benefits does not provide an opportunity for an injured worker to earn more while on claim than if they were working. The term claim will not include any form of WCB allowance or pension, and this section will not be operative while an employee is receiving such a different form of payment from WCB arising from this claim.

  • Taking annual leave (a) Any employee may take paid annual leave if sufficient annual leave has been credited to that employee and the employer has authorised the leave being taken.

  • Entitlement to Vacation Leave With Pay An employee is entitled to vacation leave with pay to the extent of his earned credits but an employee who has completed six (6) months of continuous employment may receive an advance of credits equivalent to the anticipated credits for the vacation year.

  • Cashing out annual leave The employee may, with the agreement of the employer, request in writing, to cash out up to two weeks of their annual leave during each 12 month period. Annual leave cannot be cashed out in advance of it being credited to the employee. Cashed out annual leave will be paid at the rate of pay that the employee receives at the time when the request is made.

  • Payment for annual leave (a) Before going on annual leave, an employee will be paid the amount of wages they would have received for ordinary time worked had they not been on leave during that period. (b) At the election of the employee such payments may be paid in accordance with the usual pay day relevant to the period of leave being taken.

  • Annual Leave Loading During a period of annual leave an employee will receive a loading of 17.5 per cent calculated on the employee’s normal hourly rate of pay and the daily fares allowance if applicable. The loading will also apply to proportionate leave on lawful termination.

  • Vacation Leave on Retirement ‌ An employee scheduled to retire and to receive pension benefits under the Public Service Pension Plan Rules or who has reached the mandatory retiring age, shall be granted full vacation entitlement for the final calendar year of service.
