Common use of Clean-up Activities Clause in Contracts

Clean-up Activities. If any action is required to be taken by a governmental authority to clean-up Hazardous Materials form the Premises that were released or emitted by Tenant, and such action is not completed prior to the expiration or earlier termination of the Lease, Tenant shall be deemed to have impermissibly held over until such time as such required action is completed, and in addition to the requirements of Xxxxxxxxx 00, Xxxxxxxx shall be entitled to all damages directly or indirectly incurred in connection with such holding over, including without limitation, damages occasioned by the inability to relet the Premises or a reduction of the fair market and/or rental value of the Premises.
