Common use of Coastal Construction Control Line Clause in Contracts

Coastal Construction Control Line. If any part of the Property lies seaward of the coastal construction control 172 line (“CCCL”) as defined in Section 161.053, Florida Statutes, Seller will provide Buyer with an affidavit or 173 survey as required by law delineating the line's location on the Property, unless Buyer waives this requirement 174 in writing. The Property being purchased may be subject to coastal erosion and to federal, state, or local 175 regulations that govern coastal property, including delineation of the CCCL, rigid coastal protection structures, 176 beach nourishment, and the protection of marine turtles. Additional information can be obtained from the Florida 177 Department of Environmental Protection, including whether there are significant erosion conditions associated 178 with the shoreline of the Property being purchased. 179 □ Buyer waives the right to receive a CCCL affidavit or survey.
