Common use of Code Penalties Clause in Contracts

Code Penalties. At no time throughout the Franchise term shall the Franchisee be liable for penalties under Section 5A-114(b) of the Cable Code and Liquidated Damages, set forth below, in excess of an aggregate of Two Hundred Fifty Thousand Dollars ($250,000)per year, provided however that the Town retains all other legal rights and remedies, including without limitation specific performance and injunction, for failure to comply with the Franchise Agreement, regardless of whether the cap has been reached.
