Civil Penalty. ORLY shall issue two separate checks for a total amount of five hundred dollars ($500.00) as penalties pursuant to California Health & Safety Code § 25249.12 as follows: (a) one check made payable to the State of California’s Office of Environmental Health Hazard Assessment (OEHHA) in the amount of three hundred and seventy five dollars ($375.00), representing 75% of the total penalty; and (b) one check to Xxxx Xxxxxxx in the amount of one hundred and twenty five dollars ($125.00), representing 25% of the total penalty. Additionally, two separate 1099’s shall be issued for the above payments. The first 1099 shall be issued to OEHHA, PO Box 4010, Sacramento, CA 95184 (EIN: 00-0000000) in the amount of $375.00. The second 1099 shall be issued in the amount of $125.00 to Xxxx Xxxxxxx be addressed to Xxxx Xxxxxxx C/O Xxxxxx X. Xxxxxxxx, Law Corporation and shall be delivered to Xxxxxx X. Xxxxxxxx, Law Corporation, 0000 X. Xxxxxxxxx, #649, Manhattan Beach, CA 90266. At ORLY's request, Xxxxxxx'x counsel shall provide ORLY with a W-9 for Xxxxxxx prior to the Effective Date.
Civil Penalty. 18 9. Subject to the provisions set forth in paragraph 10, the Board imposes a civil 19 penalty against the Respondent in the amount of $1,000.00.
20 10. Respondent’s payment of the civil penalty shall be stayed so long as Respondent
Civil Penalty. Within ten (10) days of the Effective Date, REP shall issue two separate checks for the Civil Penalty payment to (a) “OEHHA” in the amount of $750.00; and to (b) “Xxxxxxx Xxxxx in Trust for Xxxxxxxx” in the amount of $250.00. The Civil Penalty payment(s) shall be delivered to the addresses identified in § 3.2, below.
Civil Penalty. In settlement of EPA’s claims for civil penalties for the violations alleged in this Consent Agreement, Respondents consent to the assessment of a civil penalty in the amount of Two-Hundred Eighty Thousand dollars ($280,000), which Respondents shall be jointly and severally liable to pay in accordance with the terms set forth below.
Civil Penalty. 7. Within 30 Days after the Effective Date of this Consent Decree, Defendant shall pay the sum of $477,500 as a civil penalty, together with interest accruing from the date on which the Consent Decree is lodged with the Court, at the rate specified in 28 U.S.C. ' 1961 as of the date of lodging.
8. Defendant shall pay the civil penalty due by FedWire Electronic Funds Transfer (AEFT@) to the U.S. Department of Justice in accordance with written instructions to be provided to Defendant, following the effective date of this Consent Decree, by the Financial Litigation Unit of the U.S. Attorney=s Office for the District of Kansas, 000 Xxxxx Xxxxxx, Xxxxx 000, Xxxxxx Xxxx, Xxxxxx 00000, (000) 000-0000. At the time of payment, Defendant shall send a copy of the EFT authorization form and the EFT transaction record, together with a transmittal letter, which shall state that the payment is for the civil penalty owed pursuant to the Consent Decree in United States v. Kansas Department of Transportation, and shall reference the civil action number and DOJ case number 90-5-1-1-10420, to the United States in accordance with Section XIII of this Decree (Notices); by email to xxxxxxxxxxxxxxx.XXXXX@xxx.xxx; and by mail to: EPA Cincinnati Finance Office 00 Xxxxxx Xxxxxx Xxxx Drive Cincinnati, Ohio 45268 and Xx. Civil Penalty. 1. Within thirty (30) days of the Effective Date of this Settlement Agreement, Xxxxxx agrees to pay a civil penalty in the amount of Twenty-five Thousand Dollars ($25,000) by wire transfer, certified check or other guaranteed funds, pursuant to the instructions of the Attorneys General.
2. Xxxxxx warrants that, as of the Effective Date of this Settlement Agreement, he is not insolvent, nor will the payment required under this Settlement Agreement render him insolvent, as that term is used in the United States Bankruptcy Code.
Civil Penalty. Subject to the provisions set forth in paragraph 15, the Board imposes a civil 3 penalty against the Respondent in the amount of $1,000.00.
Civil Penalty. The Applicant shall pay a fine in the sum of one thousand dollars ($1,000.
Civil Penalty. Pursuant to Health and Safety Code section 25249.7(b)(2), and in settlement of all the claims referred to in this Settlement Agreement, Aftco shall pay $4,000 in civil penalties in accordance with this Section. The penalty payment will be allocated in accordance with California Health & Safety Code sections 25249.12(c)(1) & (d), with 75% of the funds remitted to the California Office of Environmental Health Hazard Assessment (“OEHHA”) by Xxxxxxx. On or before June 30, 2017, Aftco shall make the civil penalty payment of $4,000. Aftco shall provide its payment in a check made payable to “Xxxx Xxxxxxx, Client Trust Account” in the amount of $1,000 and a check made payable to “OEHHA” in the amount of $3,000 to be delivered to the address provided in Section 3.3, below. Xxxxxxx’x counsel shall be responsible for remitting Aftco’s penalty payment under this Settlement Agreement to OEHHA.
