Collection of Mortgage Loan Payments; Custodial Account. (a) The Servicer shall make reasonable efforts in accordance with Accepted Servicing Practices to collect all payments called for under the terms and provisions of the Mortgage Loans to the extent such procedures shall be consistent with this Agreement and the terms and provisions of any related Required Insurance Policy. Consistent with the foregoing, the Servicer may in its discretion (i) waive any late payment charge and (ii) extend the due dates for payments due on a Mortgage Note for a Mortgage Loan for a period not greater than 180 days; provided, however no such extension shall be materially adverse to the Certificateholders. In the event of any such arrangement, the Servicer shall make Advances on the Mortgage Loan during the scheduled period in accordance with the amortization schedule of such Mortgage Loan without modification thereof by reason of such arrangements, and shall be entitled to reimbursement therefor in accordance with Section 5.01. The Servicer shall not be required to institute or join in litigation with respect to collection of any payment (whether under a Mortgage, Mortgage Note or otherwise or against any public or governmental authority with respect to a taking or condemnation) if it reasonably believes that enforcing the provision of the Mortgage or other instrument pursuant to which such payment is required is prohibited by applicable law. In addition, if (x) a Mortgage Loan is in default or default is imminent or (y) the Servicer delivers to the Trustee and the Securities Administrator a REMIC Opinion, the Servicer may, (A) amend the related Mortgage Note to reduce the Mortgage Rate applicable thereto and (B) amend any Mortgage Note for a Mortgage Loan to extend the maturity thereof.

(a) The Servicer Option One shall make reasonable efforts in accordance with Accepted Servicing Practices customary and usual standards of practice of prudent mortgage lenders in the respective states in which the Mortgaged Properties are located to collect all payments called for under the terms and provisions of the Option One Mortgage Loans to the extent such procedures shall be consistent with this Agreement and the terms and provisions of any related Required Insurance Policy. Consistent with the foregoing, the Servicer Option One may in its discretion (i) waive any late payment charge and (ii) extend the due dates for payments due on a Mortgage Note for a an Option One Mortgage Loan for a period not greater than 180 125 days; provided, however no such extension shall be materially adverse to the Certificateholders. In the event of any such arrangement, the Servicer Option One shall make Advances on the related Option One Mortgage Loan during the scheduled period in accordance with the amortization schedule of such Option One Mortgage Loan without modification thereof by reason of such arrangements, and shall be entitled to reimbursement therefor in accordance with Section 5.01. The Servicer Option One shall not be required to institute or join in litigation with respect to collection of any payment (whether under a Mortgage, Mortgage Note or otherwise or against any public or governmental authority with respect to a taking or condemnation) if it reasonably believes that enforcing the provision of the Mortgage or other instrument pursuant to which such payment is required is prohibited by applicable law. In addition, if (x) a an Option One Mortgage Loan is in default or default is imminent or (y) the Servicer Option One delivers to the Trustee and a certification, based on the Securities Administrator advice of counsel or certified public accountants, in either case, that have a national reputation with respect to taxation of REMICs, that a modification of such Option One Mortgage Loan will not result in the imposition of taxes on or disqualify any of REMIC OpinionI or REMIC II, the Servicer Option One may, (A) amend the related Mortgage Note to reduce the Mortgage Rate applicable thereto thereto, provided that such reduced Mortgage Rate shall in no event be lower than 5.50% with respect to any Option One Mortgage Loan in Loan Group I, 6.00% with respect to any Option One Mortgage Loan in Loan Group II, 6.50% with respect to any Option One Mortgage Loan in Loan Group III, 7.00% with respect to any Option One Mortgage Loan in Group IV, 7.00% with respect to any Option One Mortgage Loan Group in V, 7.00% with respect to any Option One Mortgage Loan in Group VI and 5.00% with respect to any Mortgage Loan in Group VII and (B) amend any Mortgage Note for a an Option One Mortgage Loan to extend to the maturity thereof.
