Common use of Combinations Clause in Contracts

Combinations. Authorized Third Parties who obtain an Acquired Item shall be granted a non-exclusive sublicense under the Licensed Patents to: (a) make, use, sell, offer for sale, or import: (i) a combination of Acquired Items; and/or (ii) a combination of one or more Acquired Items with one or more other items; provided and to the extent that the Acquired Item(s), so combined, give rise to the combination being a Licensed Product; and provided further that, the Authorized Third Parties are not so sublicensed under this Section 2.3(a) for making, using, selling, offering for sale or importing of the one or more other items apart from such combination; and/or (b) use a method or process that includes steps implemented by an Acquired Item in combination with other steps, and to sell, offer for sale, or import products resulting from such method or process.
