AT&T-12STATE acknowledges that CLEC may have an embedded base of one-way trunks ordered and installed prior to the Effective Date of this Agreement that were used for termination of CLEC’s Section 251(b)(5)/IntraLATA Toll Traffic to AT&T-12STATE (Embedded Base). To the extent that CLEC has such an Embedded Base, CLEC shall only augment trunk groups in the Embedded Base with the mutual agreement of the Parties. CLEC shall not order any new one-way trunk groups following the Effective Date of this Agreement. Moreover, the Parties agree that the Embedded Base will be converted to two-way trunk groups under the following circumstances:
Expiración de la Licencia Esta Licencia tendrá vigencia hasta que termine su validez. Los derechos que le confiere esta Licencia también perderán su vigencia automáticamente sin el previo aviso de Apple si incumple cualesquiera términos de la presente Licencia. Usos permitidos y restricciones de la Licencia A. Licencia. De acuerdo con los términos y condiciones de esta Licencia y según lo permitido en las “Normas de uso del producto App Store” establecidas en los Términos y Condiciones de App Store (xxxx://xxx.xxxxx.xxx/legal/itunes/ww/) (“Normas de uso”) —a menos que haya obtenido el Software Apple como se describe en la sección 2B—, se le concede una licencia limitada, no transferible ni exclusiva para instalar y usar el Software Apple en cualquier dispositivo iOS de marca Apple compatible que posea o gestione. Se prohíbe distribuir o poner el Software Apple disponible a través de una red donde pueda ser utilizado simultáneamente por varios dispositivos. Usted no puede alquilar, arrendar, prestar, vender, redistribuir ni sublicenciar el Software Apple.

SBC-12STATE 47.1.1 The terms contained in this Agreement and any Appendices, Attachments, Exhibits, Schedules, and Addenda constitute the entire agreement between the Parties with respect to the subject matter hereof, superseding all prior understandings, proposals and other communications, oral or written between the Parties during the negotiations of this Agreement and through the execution and/or Effective Date of this Agreement. This Agreement shall not operate as or constitute a novation of any agreement or contract between the Parties that predates the execution and/or Effective Date of this Agreement.
Limitation de responsabilité DANS LA MESURE OÙ LA LÉGISLATION EN VIGUEUR NE L’INTERDIT PAS, EN AUCUN CAS APPLE NE SERA RESPONSABLE DE DOMMAGE CORPOREL NI DE QUELCONQUE DOMMAGE ACCIDENTEL, SPÉCIAL, INDIRECT OU ACCESSOIRE, Y COMPRIS DE FAÇON NON LIMITATIVE, LES DOMMAGES DUS AUX PERTES DE BÉNÉFICES, PERTES DE DONNÉES OU D’INFORMATIONS, INTERRUPTION DES ACTIVITÉS OU TOUT AUTRE DOMMAGE COMMERCIAL OU PERTE COMMERCIALE RÉSULTANT DE OU RELATIFS À VOTRE UTILISATION OU VOTRE INAPTITUDE À UTILISER LE LOGICIEL APPLE ET LES SERVICES OU TOUT LOGICIEL XX XXXXXX PARTIE CONJOINTEMENT AVEC LE LOGICIEL APPLE, QUELLE QU’EN SOIT LA CAUSE, SANS TENIR COMPTE DE LA THÉORIE DE LA RESPONSABILITÉ (QUE CE SOIT POUR RUPTURE DE CONTRAT, EN RESPONSABILITÉ CIVILE, OU AUTRE) ET MÊME SI APPLE A ÉTÉ INFORMÉ DE LA POSSIBILITÉ DE TELS DOMMAGES. CERTAINES JURIDICTIONS NE PERMETTANT PAS LA LIMITATION DE RESPONSABILITÉ POUR DOMMAGES PERSONNELS, INDIRECTS OU ACCESSOIRES, IL EST POSSIBLE QUE CETTE LIMITATION NE VOUS CONCERNE PAS. La responsabilité totale d’Apple envers vous au titre de tout dommage (en dehors de ce que la législation pourrait exiger dans les cas impliquant une blessure) n’excédera en aucun cas la somme de cinquante dollars (50 $). Les limitations susdites s’appliqueront même si le recours indiqué ci-dessus fait défaut à sa vocation essentielle.
