Common use of Commence Construction Clause in Contracts

Commence Construction. Subject to the terms and conditions of this Agreement and subject to delays resulting from events of Force Majeure (as hereinafter defined), the Developer will Commence Construction of the Project by or before July 1, 2021. For purposes of this Section 3.1(A), “Commence Construction” shall mean the commencement of material and substantial work on the Project pursuant to Required Permits (as defined herein below) such as installation of footings and foundations and shall not be deemed to occur as a result of mere excavation work.
