Common use of Commencement Date; Term Clause in Contracts

Commencement Date; Term. The Expansion Space D Commencement Date (“ESDCD”) shall mean the date which is one hundred fifty (150) days after the date on which Landlord delivers possession of Expansion Space D to Tenant for occupancy (which delivery is estimated to be January 1, 2019) and, upon the ESDCD (which is estimated to be June 1, 2019), Expansion Space D becomes a part of the Premises, and Tenant’s obligation to pay rent commences with respect to Expansion Space D. The Term of this lease of Expansion Space D (the “Space D Term”) shall continue until the Phase 1 Termination Date. Within thirty (30) days after request by Landlord, Tenant and Landlord shall enter into an agreement confirming the ESDCD and the Monthly Base Rent substantially in the form of Exhibit B attached hereto. If Tenant fails to enter into such agreement within ten (10) days following Landlord’s delivery of written notice of such failure to Tenant, then the ESDCD shall be the date designated by Landlord in such agreement.

The Expansion Space D A Commencement Date (the “ESDCDESACD”) shall mean the date which is one hundred fifty eighty (150180) days after the date on which Landlord delivers possession of Expansion Space D A to Tenant for occupancy (which delivery is estimated to be January October 1, 20192017) and, upon the ESDCD ESACD (which is estimated to be June April 1, 20192018), Expansion Space D A becomes a part of the Premises, and Tenant’s obligation to pay rent commences with respect to Expansion Space D. A. The Term of this lease of Expansion Space D A (the “Space D A Term”) shall continue until the Phase 1 2 Termination Date. Within thirty (30) days after request by Landlord, Tenant and Landlord shall enter into an agreement confirming the ESDCD ESACD and the Monthly Base Rent substantially in the form of Exhibit B attached hereto. Within thirty (30) days after request by Landlord, Tenant and Landlord shall enter into an agreement confirming the ESDCD ESBCD and the Monthly Base Rent substantially in the form of Exhibit B attached hereto. The Expansion Space D C Commencement Date (“ESDCDESCCD”) shall mean the date which is one hundred fifty eighty (150180) days after the date on which Landlord delivers possession of Expansion Space D C to Tenant for occupancy (which delivery is estimated to be January 1October 16, 20192017) and, upon the ESDCD ESCCD (which is estimated to be June 1April 16, 20192018), Expansion Space D C becomes a part of the Premises, and Tenant’s obligation to pay rent commences with respect to Expansion Space D. C. The Term of this lease of Expansion Space D C (the “Space D C Term”) shall continue until the Phase 1 Termination Date. Within thirty (30) days after request by Landlord, Tenant and Landlord shall enter into an agreement confirming the ESDCD ESCCD and the Monthly Base Rent substantially in the form of Exhibit B attached hereto.
