Commencement DatesIf Tenant exercises the first Renewal Option in accordance herewith, the first Renewal Term shall commence on the day following the last day of the initial Term and end on the day preceding the fifth anniversary thereof. If Tenant exercises the second Renewal Option, the second Renewal Term shall commence on the day following the last day of the first Renewal Term and end on the day preceding the fifth anniversary thereof. The second Renewal Option may not be exercised unless Tenant has previously exercised the first Renewal Option hereunder and under the 901 Gateway Lease. Each Renewal Term, if properly exercised, shall be upon the same terms and conditions as the Lease except for Monthly Base Rent (which shall be determined as provided in the following provisions of this Paragraph).
Commencement Dates. 2.1 This Agreement commences on 3 July 2018. 2.2 The Trade Union recognition rights for recognised Trade Unions are automatically transferred over when a maintained school becomes an academy. There is therefore a need to clarify the working arrangements between the trade unions and Anglian Learning in respect of consultation and negotiation and facility time for Union Representatives. The terms of the Agreement which follows provide that clarification.

Commencement Dates. (a) The Phase One Commencement Date shall be the date of substantial completion (as defined in Exhibit B) of the Tenant Improvements and Tenant Work (as hereinafter defined) to the Phase One Premises, which is to be on or before December 2, 2003, provided Tenant materially meets the benchmark deadlines set forth on Exhibit B-2 entitled “Construction Schedule” (the “Phase One Commencement Date”). In no event shall the Phase One Commencement Date be subsequent to December 2, 2003 except for delays caused by Force Majeure (as hereinafter defined) circumstances beyond Landlord’s control or as a result of a Tenant Delay (as hereinafter defined). (b) The Phase Two Commencement Date shall be the date of substantial completion of the Phase Two Premises and Tenant Improvements therefor which is to be on or before November 1, 2004 provided Tenant materially meets the benchmark deadlines set forth on the Construction Schedule (the “Phase Two Commencement Date”) and subject to delays caused by Force Majeure circumstances beyond Landlord’s control or as a result of a Tenant Delay.
Commencement Dates. (a) The Parties’ obligations hereunder with respect to the Long Beach Terminal shall commence on the date of the Berth 84/86 Sublease. (b) The Parties’ obligations hereunder with respect to Terminal 1 shall commence on the date of the Berth 121 Sublease. (c) The Parties’ obligations hereunder with respect to Terminal 2 shall commence on the date of the Terminal 2 Sublease (any of the dates on which the events occur in clauses (a), (b) or (c) being a “Commencement Date” and collectively the “Commencement Dates”).

Commencement Dates. (A) The Module M Premises are currently occupied by Biological Controls under a lease which expires April 30, 2001, although it is currently projected that Biological Controls may vacate the Module M Premises on or about April 15, 2001. The Module M Commencement Date shall be the earlier of the date on which (i) Landlord makes the Module M Premises available to Tenant for the construction by Tenant of the Module M Alterations, as defined in Paragraph 8 hereof, or (ii) Tenant first occupies all or any part of the Module M Premises. (B) The Module E Premises are currently occupied by York Telecom under a lease which expires December 31, 2001, although it is currently projected that York Telecom may vacate the Module E Premises on or about September 1, 2001. The Module E Commencement Date shall be the earlier of the date on which (i) the Landlord has obtained on behalf of Tenant, and at Tenant's expense, a certificate of occupancy, temporary or permanent, permitting occupancy of the Module E Premises by Tenant, or (ii) Tenant first occupies all or any part of the Module E Premises. (C) If, for any reason, including but not limited to the failure of the existing tenant to vacate either the Module M Premises or the Module E Premises, Landlord is unable to deliver possession to Tenant as currently projected, the Landlord shall have no liability to Tenant, the Lease shall remain in effect and such failure to deliver possession shall be of no consequence, except that the commencement date for such premises shall not occur until Landlord delivers possession of such premises to Tenant. (D) Upon request of either, Landlord and Tenant shall complete and execute a commencement date memorandum substantially in the form annexed hereto as Exhibit E to memorialize the occurrence of any one or more of the commencement dates described in this Amendment.
Commencement DatesNotwithstanding anything to the contrary set forth in Paragraph 3 of the Lease, and subject to Section 6 below: 5.1 The date on which Lessee shall be entitled to occupy the Office Area, and shall commence payment of rent therefor (whether or not Lessee occupies the Office Area), under Paragraph 3.4 of the Lease (the "Office Area Early Commencement Date") shall be the date that is the later of (i) March 1, 1997 or (ii) the date of Substantial Completion of the portion of the Initial Improvements (the "Office Improvements") consisting of improvements to (or improvements necessary for the occupancy of) the Office Area. Notwithstanding the foregoing, in the event that Lessee occupies the Office Area for its normal business operations prior to the Office Area Early Commencement Date, Lessee shall commence payment of rent and other payments for the Office Area on the first date of such early occupancy. For purposes of the Lease (including this Construction Agreement), "Substantial Completion" of the Initial Improvements (or Office Improvements, as applicable) shall occur upon (a) the completion of construction of the Initial Improvements (or Office Improvements, as applicable) pursuant to the Construction Documents, with the exception of any punch list items and any furniture, fixtures or equipment to be installed by Lessee, and (b) the issuance of a temporary or final Certificate of Occupancy for the entire Premises.
