COMMENCEMENT LETTER. Promptly following the date on which the Commencement Date has been determined, Landlord and Tenant shall execute and deliver a commencement letter in substantially the form attached hereto as Exhibit D (the “Commencement Letter”), which Commencement Letter shall memorialize the Commencement Date, Rent Commencement Date, Transaction Costs and Termination Date; provided, however, the failure of either party to execute the Commencement Letter shall not affect the rights of either party hereunder.

COMMENCEMENT LETTER. Landlord may send a commencement letter (“Commencement Letter”) to Tenant confirming the Commencement Date. The Commencement Date set forth in the Commencement Letter shall be conclusive and binding on the parties unless Tenant objects to the date in writing within ten (10) business days after delivery of the Commencement Letter.

COMMENCEMENT LETTER. Promptly following the Commencement Date, Landlord and Tenant shall enter into a letter agreement in the form attached hereto as Exhibit C, specifying and/or confirming the Commencement Date and the Expiration Date (and the rentable area of the Premises and the schedule of Base Rent payable hereunder, if such numbers as finally determined differ from those set forth in the Basic Lease Provisions); if Tenant fails to execute and deliver such letter agreement to Landlord within ten (10) business days after Landlord’s delivery of same to Tenant, said letter agreement will be deemed final and binding upon Tenant.
COMMENCEMENT LETTER. Tenant shall execute and deliver a Commencement Letter in a form reasonably acceptable to Landlord within ten (10) business days of Landlord request therefor. Such Commencement Letter shall state the Commencement Date, Base Rent Commencement Date and Expiration Date. Failure of Tenant to timely execute and deliver the Commencement Letter shall constitute an acknowledgment by Tenant that the statements included in such notice in good faith are true and correct, unless Tenant advises Landlord that such statements are incorrect.

COMMENCEMENT LETTER. Promptly after the later to occur of the Additional Premises A Commencement Date and the Additional Premises B Commencement Date, Landlord and Tenant will execute a commencement letter setting forth the exact Additional Premises A or B Commencement Date, and exact square footage of the New Premises, Fixed Rent for the New Premises, Tenant’s Share for the Demised Premises, including the New Premises, and other usual and customary provisions. Tenant may remeasure the New Premises at its election. Rent shall be adjusted depending on the exact square footage of the New Premises.
COMMENCEMENT LETTER. Landlord and Tenant will each sign and deliver to the other a Commencement Letter on the form attached as Rider No. 5 confirming the Commencement Date, the Expiration Date, the Rentable Area, and any other facts or terms that may be affected by improvements to the Premises.
