COMMENCEMENT LETTER. Promptly following the date on which the Commencement Date has been determined, Landlord and Tenant shall execute and deliver a commencement letter in substantially the form attached hereto as Exhibit D (the “Commencement Letter”), which Commencement Letter shall memorialize the Commencement Date, Rent Commencement Date, Transaction Costs and Termination Date; provided, however, the failure of either party to execute the Commencement Letter shall not affect the rights of either party hereunder.
COMMENCEMENT LETTER. Landlord may send a commencement letter (“Commencement Letter”) to Tenant confirming the Commencement Date. The Commencement Date set forth in the Commencement Letter shall be conclusive and binding on the parties unless Tenant objects to the date in writing within ten (10) business days after delivery of the Commencement Letter.

COMMENCEMENT LETTER. Following the Commencement Date and the Rent Commencement Date, Landlord shall prepare and deliver to Tenant, Tenant’s Commencement Letter in the form of Exhibit I attached hereto (the “Commencement Letter”) which Tenant shall acknowledge by executing a copy and returning it to Landlord. If Tenant fails to sign and return the Commencement Letter to Landlord or provide Tenant’s reasonable comments on the Commencement Letter within fifteen (15) days of its receipt from Landlord, the Commencement Letter as sent by Landlord shall be deemed to have correctly set forth the Commencement Date and the other matters addressed in the Commencement Letter. Failure of Landlord to send the Commencement Letter shall have no effect on the Commencement Date or the Rent Commencement Date.

COMMENCEMENT LETTER. Promptly after the Additional Premises Commencement Date, Landlord and Tenant will execute a commencement letter setting forth the exact Additional Premises Commencement Date, and exact square footage of the New Premises, Fixed Rent for the New Premises, and other usual and customary provisions. Tenant may remeasure the New Premises at its election. Rent shall be adjusted proportionately depending on the exact square footage of the New Premises.
COMMENCEMENT LETTER. Promptly following the Commencement Date, Landlord and Tenant shall enter into a letter agreement in the form attached hereto as Exhibit C, specifying and/or confirming the Commencement Date and the Expiration Date (and the rentable area of the Premises and the schedule of Base Rent payable hereunder, if such numbers as finally determined differ from those set forth in the Basic Lease Provisions); if Tenant fails to execute and deliver such letter agreement to Landlord within ten (10) business days after Landlord’s delivery of same to Tenant, said letter agreement will be deemed final and binding upon Tenant.
