Common use of Commercial General Liability and Automobile Liability Coverages Clause in Contracts

Commercial General Liability and Automobile Liability Coverages. a. The City of San Xxxx, BOARD and Plan, together with their trustees, officers, employees, agents and contractors are to be covered as additional insureds as respects: Liability arising out of activities performed by or on behalf of ACTUARY; products and completed operations of ACTUARY; premises owned, leased or used by ACTUARY; and automobiles owned, leased, hired or borrowed by ACTUARY. The coverage shall contain no special limitations on the scope of protection afforded to CITY, BOARD and Plan, together with their trustees, its officers, employees, agents and contractors. b. ACTUARY's insurance coverage shall be primary insurance as respects CITY, BOARD and Plan, and their trustees, officers, employees, agents and contractors. Any insurance or self-insurance maintained by CITY, BOARD, or their trustees, officers, employees, agents or contractors shall be excess of ACTUARY's insurance and shall not contribute with it. c. Any failure to comply with reporting provisions of the policies by ACTUARY shall not affect coverage provided CITY, BOARD and Plan, and their trustees, officers, employees, agents, or contractors. d. Coverage shall state that ACTUARY's insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the limits of the insurer's liability. e. Coverage shall contain waiver of subrogation in favor of CITY, BOARD and Plan, and their trustees, officers, employees, agents and contractors.

Any failure to comply with reporting provisions of the policies by ACTUARY PROVIDER shall not affect coverage provided CITYNAVIGATOR, BOARD and Plan, and their trustees, its officers, employees, agents, or contractorsPROVIDER’s. d. ACTUARY's Mitty’s and/or Mitty’s Subcontractors insurance coverage shall be primary insurance as respects CITYCity, BOARD and Plan, and their trustees, its officers, employees, agents and contractors. Any insurance or self-insurance maintained by CITYCity, BOARD, or their trustees, its officers, employees, agents or contractors shall be excess of ACTUARY's Mitty’s and/or Mitty’s Subcontractors insurance and shall not contribute with it. c. Any failure to comply with reporting provisions of the policies by ACTUARY Association shall not affect coverage provided CITYCity, BOARD and Plan, and their trustees, its officers, employees, agents, or contractors. d. Coverage shall state that ACTUARY's Mitty’s and Mitty’s Subcontractor’s insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the limits of the insurer's liability. e. Coverage shall contain a waiver of subrogation in favor of the CITY, BOARD and Plan, and their trustees, officersits officials, employees, agents and contractors.

ACTUARYEVALUATOR/INVESTIGATOR's insurance coverage shall be primary insurance as respects CITY, BOARD and Plan, and their trustees, its officers, employees, agents and contractors. Coverage shall state that ACTUARY's EVALUATOR/INVESTIGATOR’s insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the limits of the insurer's ’s liability. e. Coverage shall contain a waiver of subrogation in favor of the CITY, BOARD and Plan, and their trustees, its officers, employees, agents and contractors.

The City of San XxxxSUCCESSOR AGENCY, BOARD the CITY, and Plan, together with their trustees, officers, employees, agents and contractors are to be covered as additional insureds as respects: Liability arising out of activities performed by or on behalf of ACTUARYof, AUDITOR; products and completed operations of ACTUARYAUDITOR; premises owned, leased or used by ACTUARYAUDITOR; and automobiles owned, leased, hired or borrowed by ACTUARYAUDITOR. The coverage shall contain no special limitations on the scope of protection afforded to the SUCCESSOR AGENCY, the CITY, BOARD and Plan, together with their trustees, its officers, employees, agents and contractors. b. ACTUARYAUDITOR's insurance coverage shall be primary insurance as respects the SUCCESSOR AGENCY, the CITY, BOARD and Plan, and their trustees, officers, employees, agents and contractors. Any insurance or self-self- insurance maintained by the SUCCESSOR AGENCY, the CITY, BOARD, or and their trustees, officers, employees, agents or contractors shall be excess of ACTUARYAUDITOR's insurance and shall not contribute with it. c. Any failure to comply with reporting provisions of the policies by ACTUARY AUDITOR shall not affect coverage provided the SUCCESSOR AGENCY, the CITY, BOARD and Plan, and their trustees, officers, employees, agents, or contractors. d. Coverage shall state that ACTUARY's AUDITOR’s insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the limits of the insurer's ’s liability.. T-30521.004\1283633 e. Coverage shall contain a waiver of subrogation in favor of the SUCCESSOR AGENCY, the CITY, BOARD and Plan, and their trustees, officers, employees, agents and contractors.

Any failure to comply with reporting provisions of the policies by ACTUARY SAN XXXX SEARCH AND RESCUE shall not affect coverage provided CITY, BOARD and Plan, and their trustees, its officers, employees, or agents, or contractors. d. Coverage shall state that ACTUARY's SAN XXXX SEARCH AND RESCUE’s insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the limits of the insurer's ’s liability. e. Coverage shall contain a waiver of subrogation in favor of CITYthe City, BOARD and Plan, and their trustees, its officers, employees, agents and contractorsagents.

Commercial General Liability and Automobile Liability Coverages. a. The City of San Xxxx, BOARD and Plan, together with their trustees, Xxxx its officers, employeesagents, agents employees and contractors volunteers are to be covered as additional insureds as respects: Liability arising out of activities performed by or on behalf of ACTUARYof, TENANT; products and completed operations of ACTUARYTENANT; premises owned, leased or used by ACTUARYTENANT; and automobiles owned, leased, hired or borrowed by ACTUARYTENANT. The coverage shall contain no special limitations on the scope of protection afforded to CITY, BOARD and Plan, together with their trustees, CITY its officers, employees, agents agents, volunteers and contractors. At such time as QALICB is granted a ground lease of the site and enters into a Master Lease with CITY, TENANT shall include QALICB as additional insured as part of these Insurance Requirements. b. ACTUARY's TENANT'S insurance coverage shall be primary insurance as respects CITY, BOARD and Plan, and their trustees, CITY its officers, employees, agents and contractorsTENANTS. Any insurance or self-self- insurance maintained by CITY, BOARD, or their trustees, CITY its officers, employees, agents or contractors TENANTS shall be excess of ACTUARY's TENANT'S insurance and shall not contribute with it. c. Any failure to comply with reporting provisions of the policies by ACTUARY TENANT shall not affect coverage provided CITY, BOARD and Plan, and their trustees, CITY its officers, employees, agents, or contractorsTENANTS. d. Coverage shall state that ACTUARY's TENANT’S insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the limits of the insurer's liability. e. The coverage shall contain no special limitations on the scope of protection afforded to CITY, BOARD and Plan, together with their trusteesSUCCESSOR AGENCY, its officers, employees, agents agents, and contractors. Owned automobiles may be insured under CONSULTANT’s personal insurance policies and may not cover the above-referenced additional insureds. b. ACTUARYCONSULTANT's insurance coverage shall be primary insurance as respects CITY, BOARD and PlanSUCCESSOR AGENCY, and their trustees, its officers, employees, agents agents, and contractors. Any insurance or self-insurance maintained by CITY, BOARDSUCCESSOR AGENCY, or their trustees, its officers, employees, agents agents, or contractors shall be excess of ACTUARYCONSULTANT's insurance and shall not contribute with it. c. Coverage shall contain a waiver of subrogation in favor of the CITY, BOARD and PlanSUCCESSOR AGENCY, and their trustees, its officers, employees, agents agents, and contractors.
