Commissioning Period. All cost incurred during the Project commissioning.
Commissioning Period. 2.4.1 The “Commissioning Period” shall be a period commencing on the Flow Date and ending on the earlier of (i) the date upon which the Sellers notify the Buyer that they have completed the commissioning of the Sellers’ Facilities, and (ii) the date of expiry of ninety (90) days following the Flow Date.
2.4.2 The Sellers will provide to the Buyer not less than fourteen (14) days’ prior notice of the commencement of the Commissioning Period. During the Commissioning Period the Sellers may carry out commissioning activities of the Sellers’ Facilities.
Commissioning Period. 2.4.1 The Commissioning Period shall be a period commencing on the Availability Date and ending on the earlier of: (i) the date upon which the Buyer and the Sellers complete the commissioning of their respective facilities; and (ii) [***] days following the Availability Date. During such period (the “Commissioning Period”) the Sellers and the Buyer (in liaison with the Transporter) shall in cooperation with each other carry out commissioning activities of their respective facilities.
2.4.2 During the Commissioning Period, the Sellers shall use reasonable endeavors to make available for delivery Specification Gas nominated by Buyer in such quantities and at such rates as may reasonably be requested by Buyer to carry out the commissioning and testing of the Buyer’s Facilities and the relevant parts of the Downstream System.
2.4.3 The Parties shall use reasonable endeavors:
(a) to co-ordinate their activities in relation to the commissioning of the facilities to the intended effect that, to the extent practicable, the Sellers’ Facilities, the relevant parts of the Downstream System and the Buyer’s Facilities will be commissioned during the Commissioning Period; and
(b) to facilitate generally the commissioning of each other’s facilities and equipment.
Commissioning Period. (a) For any GTA, the “Commissioning Period”, if any, shall be as specified in the relevant GTA. If no such Commissioning Period is specified in a GTA, this Clause 4.4 shall not apply to such GTA.
(b) The GTA shall set forth any modifications of the applicability of certain terms and conditions of this Framework Agreement, including any provisions relating to Monthly Ship-or-Pay Payment or other charges, during such Commissioning Period, if any.
(c) To the extent the GTA does not expressly modify the applicability of the terms and conditions of this Framework Agreement during a Commissioning Period or does not establish a Commissioning Period, all terms and conditions of this Framework Agreement shall apply during the full duration of such GTA subject to Clause 3. CLAUSE 5 - CHARGES
Commissioning Period. 7.2.1 Seller shall, acting in accordance with Applicable Law and Good Industry Practices, perform the Commissioning of the Plant.
7.2.2 Subject to agreement to the contrary by the Parties on the Commissioning Procedures pursuant to Clause 0, Seller will give Buyer not less than forty-five (45) Days’ prior notice of the date the Plant is expected to commence Commissioning and the expected duration of the Commissioning Period and shall give five Days’ notice to Buyer of any change in the Commissioning Period that will affect any test Buyer is entitled to witness or accelerate or delay the Commercial Operations Date.
7.2.3 In the event that the Commissioning of the Plant is not successfully completed by the expiration of the Commissioning Period, the Commissioning Period shall be extended until completion of the Commissioning Procedures and Seller shall ensure that the Commissioning is carried out and successfully completed as soon as practicable.
Commissioning Period. [applicable only on New Facility]
i. The Shipper shall be allowed for a “Commissioning Period” beginning on the Start Date and ending at 6:00 Hours on the date that is up to six (6) months following the Start Date.
ii. During such Commissioning Period, the Monthly Ship or Pay shall be NIL for the first months and for the next months the Monthly Ship or Pay shall be 50%.
iii. Provided further, the provisions of Article 7 (Liquidated Damages) of the GTA shall not apply during the Commissioning Period.
iv. During the first months of Commissioning Period imbalances and overrun charges shall not be payable by the Shipper.
Commissioning Period. (i) During the Commissioning Period, the Operator shall include the Commissioning Fee and Mobilization Fee, if applicable, on the Monthly Invoice. Each Monthly Invoice for the Commissioning Fee shall identify the actual amount of Dry Tonnes of Biosolids processed by Operator in the prior month.
Commissioning Period. It is the period between the date of issuance of the Completion Certificate of the corresponding Phase, if applicable, or the Completion Certificate of the Works and the issuance of the corresponding Commissioning Certificate.
Commissioning Period. The first two (2) Billing Periods, or such longer or shorter period as mutually agreed by the Parties, shall constitute the “Joint Commissioning Period”. The Testing Period shall commence immediately following the Commissioning Period. TERMS IN THIS EXHIBIT HAVE BEEN REDACTED BECAUSE CONFIDENTIAL TREATMENT FOR THOSE TERMS HAS BEEN REQUESTED. THE REDACTED MATERIAL HAS BEEN FILED SEPARATELY WITH THE SECURITIES AND EXCHANGE COMMISSION, AND THE TERMS HAVE BEEN MARKED AT THE APPROPRIATE PLACE WITH TWO BRACKETED ASTERISKS [**].
Commissioning Period. The Commissioning Period will commence on the Commissioning Period Commencement Date and terminate on the earlier of:
(a) the Supply Period Commencement Date; and
(b) the Termination Date.
