Common use of Communication with the Operator Clause in Contracts

Communication with the Operator. Landlord and Tenant acknowledge and agree that the Landlord is hereby authorized to communicate directly with the Operator in connection with the operation of the Retirement Community and in connection with certain terms and provisions set forth in the Operating Agreement, provided that Landlord shall not take any action that would solely by reason of such action cause Tenant to be in default under the Operating Agreement, the Pooling Agreement or the Owner Agreement. Landlord acknowledges that it will accept the performance, by Operator on behalf of Tenant, of all of the covenants, conditions and obligations of Tenant contained in this Agreement.
