Common use of Company’s Right to Terminate Clause in Contracts

Company’s Right to Terminate. Notwithstanding the provisions of Section 3.1, Company shall have the right to terminate Executive’s employment under this Agreement at any time for any of the following reasons: (a) upon Executive’s death; (b) upon Executive’s Disability; (c) for Cause; or (d) at any time, for any other reason whatsoever, in the sole discretion of the Board.

Company’s Right to Terminate. Notwithstanding the provisions of Section 3.1, Company shall have the right to terminate Executive’s employment under this Agreement at any time for any of the following reasons: (a) upon Executive’s death; (b) upon Executive’s Disability; (c) for Cause; or (d) at any time, for any other reason whatsoever, in the sole discretion of the Board; provided, however, that Company may not terminate Executive’s employment pursuant to this Section 3.2(d) prior to the date that is four months after the Effective Date.

Company’s Right to Terminate. Company’s Right to Terminate. Notwithstanding the provisions of Section 3.1paragraph 2.1, Company, acting pursuant to an express resolution of the Board of Directors of Company (the "Board of Directors"), shall have the right to terminate Executive’s 's employment under this Agreement at any time for any of the following reasons: (a) upon Executive’s death; (b) upon Executive’s Disability; (c) for Cause; or (d) at any time, for any other reason whatsoever, in the sole discretion of the Board.

Company’s Right to Terminate. Notwithstanding the provisions of Section 3.1paragraph 2.1, Company shall have the right to terminate Executive’s 's employment under this Agreement at any time for any of the following reasons: (ai) upon Executive’s 's death; (bii) upon Executive’s Disability; (c) for Cause; or (d) at any time's becoming incapacitated by accident, for any sickness, or other reason whatsoevercircumstances which, in the sole discretion opinion of a physician selected by Company, renders him mentally or physically incapable of performing the Board.duties and services required of him hereunder;

Notwithstanding the provisions of Section 3.1paragraph 2.1, Company shall have the right to terminate Executive’s employment under this Agreement at any time for any of the following reasons: (ai) upon Executive’s death; (bii) upon Executive’s Disabilitydisability, which shall mean Executive’s becoming incapacitated by accident, sickness, or other circumstances which renders him mentally or physically incapable of performing the duties and services required of him hereunder for ninety (90) or more consecutive days out of any consecutive one hundred eighty (180)-day period; (c) for Cause; or (d) at any time, for any other reason whatsoever, in the sole discretion of the Board.

Company’s Right to Terminate. Notwithstanding At any time during the provisions of Section 3.1Employment Period, the Company shall have the right to terminate Executive’s employment under this Agreement at any time for any of the following reasons: (ai) upon Upon the Executive’s death;'s Disability (as defined below), (bii) upon Executive’s Disability; For Cause (c) for Causeas defined in Section 7); or (diii) at any time, for For any other reason whatsoever, in the sole and complete discretion of the BoardCompany.

Notwithstanding the provisions of Section 3.14.1, the Company shall have the right to may terminate Executive’s employment under this Agreement at any time for any of the following reasonsreasons by providing Executive with a Notice of Termination: (a) upon Executive’s death;the determination that Executive is Disabled; or (b) upon Executive’s Disability;death; or (c) for Cause; or (d) at any time, for any other reason whatsoeverwhatsoever or for no reason at all, in the sole discretion of the BoardCompany.
