Compensatory Offset of Regulatory Allocations. To the extent it is able to, the Partnership shall make offsetting allocations of Net Income and Net Loss to the Partners in Fiscal Years after allocations are made pursuant to Section 5.2(c)(i) through (iv) or an allocation of Net Loss is disallowed pursuant to Section 5.2(c)(v) so that the Partners’ respective Capital Account balances are equal to the amounts they would have been at if no such allocations or limitation on allocations had occurred.
