Common use of Competing Business Clause in Contracts

Competing Business. “Competing Business” shall mean any person or entity that engages in a business that is the same or substantially similar to the Employer’s Business, and only that portion of the business that is in competition with the Employer’s Business.

Competing Business. “Competing Business” shall mean any person individual, business, firm, company, partnership, joint venture, organization, or other entity that engages engaged in a the wholesale distribution or retail sales of wireless communication equipment in any domestic or international market area in which Employer, Parent or any of their Affiliates does business that is the same at any time during Employee’s employment with Employer or substantially similar to the Employer’s Business, and only that portion any of the business that is in competition with the Employer’s Businessits Affiliates.

Competing Business. “Competing Business” " shall mean any person individual, business, firm, company, partnership, joint venture, organization, or other entity that engages engaged in a the industrial maintenance services and specialty fabrication businesses in Canada and the United States of America market areas in which the Company or any of its Affiliates does business that is at any time during the same or substantially similar to the Employer’s Business, and only that portion of the business that is in competition Executive's employment with the Employer’s BusinessCompany.

Competing Business. “Competing Business” " shall mean any person individual, business, firm, company, partnership, joint venture, organization, or other entity that engages engaged in a business that is the same wholesale distribution or substantially retail sales of wireless communication equipment, similar to the Employer’s Business, and only that portion in any domestic or international market area in which Employer, Parent or any of the their Affiliates does business that is in competition at any time during Employee's employment with the Employer’s BusinessEmployer or any of its Affiliates.

The Company hereby acknowledges and agrees that the Consultant's and Pennie's prior responsibilities as Chairman & CEO of an industrial environmental services company does not conflict with the definition of a Competing Business.

The Company hereby acknowledges and agrees that the Consultant's current Management Designee's responsibilities as Chairman & CEO of an industrial environmental services company does not conflict with the definition of a Competing Business.

Competing Business. “Competing Business” " shall mean any person individual, business, firm, company, partnership, joint venture, organization, or other entity that engages primarily engaged in a the wholesale or retail distribution of wireless handheld mobile phones in any domestic or international market area in which Employer, Parent or any of their Affiliates does business that is at any time during the same Employee's employment with Employer or substantially similar to the Employer’s Business, and only that portion any of the business that is in competition with the Employer’s Businessits Affiliates.

Competing Business. “Competing Business” " shall mean any person ------------------ individual, business, firm, company, partnership, joint venture, organization, or other entity that engages engaged in a the wholesale distribution or retail sales of wireless communication equipment in any domestic or international market area in which Employer, Parent or any of their Affiliates does business that is at any time during the same Employee's employment with Employer or substantially similar to the Employer’s Businessany of its Affiliates, except SBC Communications, Inc. and only that portion of the business that is in competition with the Employer’s Businessits wholly-owned subsidiaries.
