Common use of Competing Services Clause in Contracts

Competing Services. Subject to the provisions of this Section, and Contractor’s obligations with respect to Confidential Information, nothing in this Contract shall preclude or limit in any way the right of Contractor to:(i) in compliance with the law, provide the services similar to those contemplated in this Contract, or consulting, or other services of any kind or nature whatsoever to any individual or entity as Contractor in its sole discretion deems appropriate, or (ii) develop for Contractor or for others, deliverables or other materials that are competitive with those produced as a result of the Services provided hereunder, irrespective of their similarity to the Contract deliverables. Each party shall be free to utilize any concepts, processes, know-how, techniques, improvements or other methods it may develop during the course of performance under this Contract free of any use restriction or payment obligation to the other.
