The 'COMPETITION INTENDED' clause defines the parties' understanding that the agreement is designed to foster or maintain competition within a particular market or industry. In practice, this clause may clarify that the contract does not aim to create a monopoly, restrict fair trade, or otherwise violate antitrust laws, and may specify that both parties are free to compete with each other or with third parties. Its core function is to ensure compliance with competition laws and to prevent the agreement from being interpreted as anti-competitive, thereby reducing legal risk for the parties involved.
COMPETITION INTENDED. It is Poquoson City Public Schools (PCPS) intent that this Request for Proposal (RFP) for Copier – Lease and Maintenance Agreement allows competition. It shall be the Offeror’s responsibility to advise the Executive Director of Finance in writing if any language, requirement, specification, etc. or any combination thereof, inadvertently restricts or limits the requirements stated in the RFP to a single source. The Executive Director of Finance must receive such notification not later than seven (7) days prior to the date set for acceptance of proposals.

Such notifications must be received by the BRWA five (5) days prior to the date set for the receipt of proposals.

The Purchasing Director must receive such notification not later than five (5) business days after solicitation release date
