The Compliance Determinations clause establishes the process by which one party assesses whether the other party is adhering to relevant laws, regulations, or contractual obligations. Compliance Determinations. (a) The FAA or EASA may also request that specific compliance determinations be made in association with the witnessing of tests or other activities. Such statements of compliance shall be made to the airworthiness or environmental standards of the requesting CA. (b) The EASA or FAA statements of conformity shall be sent in a formal letter, transmitted electronically, to the requesting EASA office or FAA ACO.
Compliance Determinations. Mortgagor acknowledges that any determinations Mortgagee makes under this Section regarding compliance with environmental laws shall be made for Mortgagee's benefit only and are not intended to be relied upon by any other party.
Compliance Determinations. It is expressly understood and agreed that, although the Executive and the Company consider the restrictions contained in the Covenants to be reasonable, if a final judicial determination is made by a court of competent jurisdiction that the time or territory or any other restriction contained in the Covenants is an unenforceable restriction against the Executive, for which injunctive relief is unavailable, the provisions of the Covenants shall not be rendered void but shall be deemed amended to apply as to such maximum time and territory and to such maximum extent as such court may judicially determine or indicate to be enforceable. Alternatively, if any court of competent jurisdiction finds that any restriction contained in the Covenants is unenforceable, and such restriction cannot be amended so as to make it enforceable, such finding shall not affect the enforceability of any of the other restrictions contained in the Covenants or other provisions of this Agreement.

The District shall promptly notify a Connecting Entity in writing of any discharge which the District determines violates its requirements. Unless objected to in writing within thirty (30) calendar days, the District’s determination shall be deemed correct. If an objection is filed with the District, the District Engineer shall review the matter and attempt to resolve the matter informally.
