Common use of Compliance Monitoring; Fees Clause in Contracts

Compliance Monitoring; Fees. (a) The Owner acknowledges that Section 42 of the Code requires the Authority to monitor the compliance of the Owner and the Project with the requirements of Section 42 of the Code. The Owner agrees to strictly comply, at all times, with the Compliance Manual, the terms and provisions of which are by this reference incorporated in this Agreement and made a part hereof; and to take all actions required by the Authority pursuant to the Compliance Manual to assist or cooperate with the Authority in monitoring such compliance.

Compliance Monitoring; Fees. (a) The Owner acknowledges that Section 42 of the Code requires the Authority to monitor the compliance of by the Owner and the Project with the requirements of said Section 42 of the Code. The Owner 42, and agrees to strictly comply, at all times, with the Authority's Low-Income Housing Tax Credit Compliance Manual, as amended from time to time, (the "Compliance Manual"), the terms and provisions of which are by this reference incorporated in this Agreement and made a part hereof; . In the event of any conflict between the provisions of this Agreement and to take all actions required by the Authority pursuant to provisions of the Compliance Manual to assist or cooperate with the Authority in monitoring such complianceManual, this Agreement shall control.
