All RSA products, services (including but not limited to pre-packaged professional services offerings and Hosted Services) and publications are commercial in nature. The Software software, Hosted Services, publications and accompanying software documentation are deemed to be “commercial computer software” "Commercial Items," as that term is defined in 48 C.F.R.§2.101, consisting of "Commercial Computer Software" and “commercial computer software documentation”, respectively, pursuant to DFARS Section 227.7202 "Commercial Computer Software Documentation," as such terms are defined in 48 C.F.R. §252.227- 7014(a)(1) and FAR Section 12.212(b48 C.F.R. §252.227-7014(a)(5), as applicable. Any useand used in 48 C.F.R. §12.211, modification, reproduction, release, performing, displaying or disclosing of the Software 48 C.F.R. §12.212 and documentation by or for the U.S. Government shall be governed solely by the terms and conditions of this XXXX.48 C.F.R.
