Compliance with principles relating to processing Personal Data The Restaurateur understands that, through its use of the various functionalities of the Application, it is issuing instructions to TheFork as to the performance of this Agreement, and in particular as to the processing of Personal Data to be carried out by TheFork as a processor. Compliance with principles relating to processing Personal Data The Restaurateur and TheFork process Personal Data in the course of taking, managing and monitoring reservations, each within the limits of its respective role and responsibilities, as set out below. Compliance with principles relating to processing Personal Data The Restaurateur accepts the scope and the limits of the functionalities of the Application as proposed by TheFork and understands that, through its use of the various functionalities of the Application, it is issuing instructions to TheFork as to the performance of this Agreement, and in particular as to the processing of Personal Data to be carried out by TheFork on behalf of the Restaurateur. Furthermore, the Restaurateur shall be solely responsible for and undertakes to ensure: - the lawful, fair and transparent nature of the collection and processing of Personal Data (including without limitation the provision of information to data subjects, and obtaining consent when required, in particular due to the purpose and methods of processing or the nature of the data collected and processed).
