Furthermore, the Restaurateur shall be solely responsible for and undertakes to ensure: - the lawful, fair and transparent nature of the collection and processing of Personal Data, including without limitation the provision of information to data subjects and obtaining consent where required, in particular due to the purpose or methods of processing or the nature of the data collected and processed), in accordance with the above provisions contemplating the different reservation methods; - that this data is only processed for the purposes set out in this Agreement, and that it is not further processed for any purpose incompatible with these; - that the Personal Data collected and processed for the purpose of managing customers relations is suitable, relevant, not excessive, objective and limited to that which is necessary with regard to the purpose for which it is processed and that the collection of such data is not unlawful. The Restaurateur undertakes not to collect financial data such as credit card numbers. Likewise, it undertakes not to collect and/or process, except where strictly necessary for the purposes for which it is processed and only after having obtained the prior express specific and informed consent of data subject, sensitive Personal Data, such as religious, political opinions, health data or data on sexual life or orientation; - the quality, validity, updating and accuracy of this data in the Application; to this end the Restaurateur undertakes to carry out the updates, corrections, or deletion of Personal Data processed in the Application; - that Personal Data will not be retained in a format permitting the identification of the data subject for a period exceeding what is necessary for the purposes set out in this Agreement; - that access to Personal Data is strictly limited on a strict need-to-know basis. The Restaurateur indemnifies and holds TheFork harmless against any claim by data subjects whose Personal Data is processed for the purpose of managing customer relations. As data controller, the Restaurateur undertakes to provide TheFork with all of the information and elements necessary for TheFork to comply with its own data protection obligations.. 6.1.2 b) Security and confidentiality TheFork warrants that it implements all appropriate technological and organisational measures necessary to preserve the security and in particular the confidentiality of the Personal Data to which it may have access, or which may be disclosed to it, or more generally, which it may process as part of the performance of this Agreement. TheFork shall therefore take all appropriate technical and organisational measures, taking into account the state of the art, the costs of xxx xxxx till nytta för TheFork vid förberedelserna av ovan nämnda meddelande och information. 6.1.1 e) Verifikation TheFork får utföra alla kontroller, inklusive och utan begränsning inom appen, som TheFork anser vara till nytta för att kontrollera att restaurangägaren efterlever sina dataskyddsskyldigheter vid användning av appen. 6.1.2. Bokningar via bokningsmodulen med ”xxxx xxxxx” xxxxx direkt hos restaurangägaren Vid användning av de tjänster som tillhandahålls av TheFork och i enlighet med GDPR, är restaurangägaren personuppgiftsansvarig i syfte att göra, hantera och övervaka bokningar som görs via bokningsmodulen med ”xxxx xxxxx” xxxxx som tas direkt av restaurangägaren. Som personuppgiftsansvarig kan TheFork å restaurangägarens vägnar behandla personuppgifter xxxxx xx åtkomst till dem. I detta sammanhang fördelas parternas roller och ansvar så här. 6.1.2 a) Efterlevnad av principerna som rör behandling av personuppgifter Restaurangägaren godtar omfattningen av och gränserna för de funktioner som finns i appen som tillhandahålls av TheFork och förstår att denne genom sin användning av de olika funktionerna i appen ger instruktioner till TheFork i xxxxx xx utförandet av detta kontrakt, och i synnerhet vad beträffar behandlingen av personuppgifter som TheFork ska utföra för restaurangägarens räkning. Restaurangägaren ska dessutom ensamt ansvara för och åtar sig att säkerställa: - Att insamlingen och behandlingen av personuppgifter är laglig, rättvis och transparent (inklusive xxxxx annat tillhandahållande av information till registrerade samt att erhålla samtycke då så krävs, i synnerhet på xxxxx xx behandlingens syfte och metoderna för den xxxxx xxxxx av de uppgifter som samlas in och behandlas). I detta hänseende ska restaurangägaren via appen konfigurera ett meddelande till de registrerade om datainsamlingen då personuppgifter samlas in via bokningsmodulen med ”xxxx xxxxx”. - Att dessa uppgifter bara behandlas för de ändamål som anges i detta kontrakt och att ingen vidare behandling sker för något ändamål som inte är förenligt med dessa. - Att de personuppgifter som samlas in och behandlas för att ta emot, hantera och övervaka bokningar är lämpliga, relevanta, inte överflödiga, objektiva samt begränsade till det som är nödvändigt för det ändamål som de behandlas för, samt att insamlingen xx xxxxxx uppgifter inte är olaglig. Restaurangägaren åtar sig att inte samla in och/xxxxx behandla finansiella uppgifter som kreditkortsnummer. Denne åtar sig även att inte samla in och/xxxxx behandla känsliga personuppgifter, till exempel om religion xxxxx politiska åsikter, uppgifter som rör hälsa xxxxx uppgifter som rör sexualliv xxxxx sexuell läggning, förutom då detta är strikt nödvändigt för det ändamål som de behandlas för och enbart efter att ha fått uttryckligt, specifikt och informerat samtycke xxxx den registrerade. - Kvaliteten av, giltigheten för, uppdatering av och korrektheten för dessa uppgifter i appen. Restaurangägaren åtar sig att för detta ändamål utföra uppdateringar, rättelser xxxxx borttagningar av personuppgifter som behandlas i appen. - Att personuppgifter inte lagras i ett format som gör det möjligt att identifiera de registrerade under en period som överskrider det som krävs för de ändamål som anges i detta kontrakt; och - att åtkomst till personuppgifter strikt begränsas till vad som är strikt nödvändigt. Restaurangägaren ska ersätta XxxXxxx och hålla det skadeslöst gentemot eventuella krav xxxx registrerade som rör någon av restaurangägarens och/xxxxx personalens skyldigheter i xxxxx xx behandling av uppgifter i syfte att ta emot, hantera och övervaka bokningar som görs direkt av restaurangägaren xxxxx via modulen med ”xxxx xxxxx”. Som personuppgiftsansvarig åtar sig restaurangägaren att till TheFork tillhandahålla all information och alla element som är nödvändiga för att TheFork ska kunna efterleva xxxx xxxx dataskyddsskyldigheter. 6.1.2 b) Säkerhet och konfidentialitet TheFork garanterar att det använder alla nödvändiga tekniska och organisatoriska åtgärder för at upprätthålla säkerheten och i synnerhet konfidentialiteten för de personuppgifter som TheFork kan få åtkomst till xxxxx som har avslöjats för TheFork, som TheFork kan behandla som en del av utförandet av detta kontrakt. Därför ska TheFork vidta alla lämpliga tekniska och organisationsmässiga åtgärder, även med beaktande av aktuell teknisk nivå,

Vardera parten åtar sig att efterleva de principer och skyldigheter som gäller för parten i fråga om skydd för personuppgifter, inklusive GDPR. Restaurangägaren åtar sig och garanterar att denne ska efterleva tillämpliga bestämmelser som rör direktmarknadsföring som är riktade till de registrerade, inklusive i fråga om villkoren som gäller för datainsamling, information eller att erhålla samtycke från de registrerade. Restaurangägaren ska ersätta TheFork och hålla det skadeslöst gentemot eventuella krav från registrerade vars personuppgifter restaurangägaren behandlar för att hantera kundrelationer till användarna, i synnerhet direktmarknadsföring. Då personuppgifter samlats in genom bokningsmodulen med ”grått märke” eller i portalen, åtar sig restaurangägaren att efterleva TheForks sekretess- och cookiemeddelande som visas i portalen. Då personuppgifter samlats in genom bokningsmodulen med ”vitt märke” eller direkt av restaurangägaren, ska restaurangägaren inte använda några av TheForks märken eller logotyper i sin kommersiella kommunikation som skickas till kunder och/eller potentiella kunder. Ingen av parterna kan under några som helst omständigheter hållas ansvarig för behandlingen av personuppgifter som utförs av den andra parten i syfte att hantera kundrelationer till användarna, inklusive att skicka kommersiella uppgifter, kommunikation, uppgifter om verksamhetens utveckling, direktmarknadsföring och andra marknadsföringsaktiviteter. 6.2.2 Specifika faktorer som är kopplade till restaurangägarens användning av appen då denne handlar för egen räkning för ovan nämnda ändamål Då restaurangägaren använder de tjänster som TheFork tillhandahåller och i enlighet med betydelsen i GDPR, är restaurangägaren personuppgiftsansvarig för behandlingen av personuppgifter då syftet med behandlingen är att hantera kundrelationer till användarna, inklusive bland annat kommersiell kommunikation och marknadsföring, inklusive direktmarknadsföring. Då restaurangägaren använder appen för detta ändamål får TheFork som personuppgiftsbiträde behandla eller få åtkomst till sådana uppgifter för restaurangägarens räkning. In geen geval kan een partij aansprakelijk xxxxxx gesteld voor de verwerking van Persoonsgegevens door de andere partij ten behoeve van het beheer van klantenrelaties met Gebruikers, waaronder organisatie van promoties, verzending van commerciële mededelingen, bedrijfsontwikkeling, direct marketing en andere marketingactiviteiten. 6.2.2 Specifieke factoren die verband houden met het gebruik van de Applicatie door de Restauranthouder die voor eigen rekening voor de hierboven vermelde doeleinden handelt Bij gebruikmaking van de door TheFork aangeboden diensten en binnen de betekenis van de AVG is de Restauranthouder de verwerkingsverantwoordelijke voor de Persoonsgegevens die bedoeld zijn voor het beheer van de klantenrelaties met Gebruikers, met inbegrip van, maar niet beperkt tot, commerciële mededelingen en marketing, waaronder direct marketing. Indien de Restauranthouder de Applicatie voor dit doel gebruikt, kan TheFork deze gegevens, als een verwerker, namens de Restauranthouder verwerken of raadplegen. Xx xxxxxx en verantwoordelijkheden van de partijen in deze omstandigheden zijn als volgt verdeeld. 6.2.2 a) Naleving van de beginselen met betrekking tot de verwerking van Persoonsgegevens De Restauranthouder beseft dat hij door zijn gebruik van de verschillende functionaliteiten van de Applicatie TheFork instructies geeft met betrekking tot de uitvoering van deze Overeenkomst, en in het bijzonder met betrekking tot de verwerking van Persoonsgegevens door TheFork als verwerker. Verder is de Restauranthouder er als enige verantwoordelijk voor en zal hij ervoor zorgen: - dat de verzameling en verwerking van Persoonsgegevens op een rechtmatige, eerlijke en transparante wijze plaatsvinden (met inbegrip van, maar niet beperkt tot, de verstrekking van informatie aan betrokkenen, de verkrijging van eventueel vereiste toestemmingen, in het bijzonder in verband met het doel of de methoden van verwerking xxx wel de aard van de verzamelde en verwerkte gegevens), in overeenstemming met de bovenstaande bepalingen die op de verschillende reserveringsmethoden betrekking hebben; - dat deze gegevens xxxxxx xxxxxx verwerkt voor de in deze Overeenkomst genoemde doeleinden en niet verder xxxxxx verwerkt voor doeleinden die daarmee onverenigbaar zijn; - dat de Persoonsgegevens die ten behoeve van het beheer van klantrelaties xxxxxx verzameld en verwerkt, geschikt, relevant, proportioneel en objectief zijn en beperkt blijven tot hetgeen noodzakelijk is voor het doel waarvoor deze xxxxxx verwerkt en het verzamelen van dergelijke gegevens niet wederrechtelijk is. De Restauranthouder zal geen financiële gegevens zoals creditcardnummers verzamelen. Evenzo zal hij geen gevoelige Persoonsgegevens, zoals geloofsovertuigingen, politieke opvattingen, gezondheidsgegevens of gegevens over de seksuele activiteit of geaardheid, verzamelen en/of verwerken, behalve voor zover dit strikt noodzakelijk is voor de doeleinden waarvoor deze xxxxxx verwerkt en alleen na verkrijging van de voorafgaande uitdrukkelijke en geïnformeerde instemming van de betrokkene; - dat deze gegevens in de Applicatie xxx xxxx kwaliteit, geldig, actueel en accuraat blijven; daartoe zal de Restauranthouder de actualisering, correctie of verwijdering uitvoeren van Persoonsgegevens die in de Applicatie xxxxxx verwerkt; - dat Persoonsgegevens niet xxxxxx bewaard in een formaat waarmee de betrokkene gedurende een langere periode xxx xxxxxx geïdentificeerd xxx nodig is voor de doeleinden die in deze Overeenkomst zijn omschreven; - dat de toegang tot Persoonsgegevens strikt beperkt blijft tot het absoluut noodzakelijke. De Restauranthouder zal XxxXxxx vrijwaren tegen en schadeloosstellen voor elke vordering van betrokkenen xxxx Persoonsgegevens door de Restauranthouder xxxxxx verwerkt ten behoeve van het beheer van de klantenrelaties.
