Concerning the Concurrent Use. Floating Licenses, the facility-bound concurrent use / floating licenses stated in the order confirmation may be respectively used by the Licensor at a site it has specified. The transfer of licenses to another facility of the Licensee requires the prior written approval of the Licensor. A transfer may not take place more than twice per year. The risks associated with such a transfer are borne by the Licensee. The associated costs and expenses must be borne by the Licensee. The global Concurrent Use / Floating Licenses stated in the order confirmation may be used by the client globally within its company and its affiliated companies pursuant to Articles 15 et seq of the German Stock Corporation Act (AktG). Use by third parties, in particular external service providers (with the exception of service providers in the area of maintenance, repair, transfer and retrofitting for coordinate measuring devices or coordinate measuring machines), customers and suppliers, is permitted provided these operate in the name of the Licensee. Third parties who are granted a right of use are obliged to comply with the terms of the license.
