Common use of Concurrent Delays Clause in Contracts

Concurrent Delays. If an Inexcusable Delay occurs concurrently with either an Excusable Delay or a Compensable Delay, the Contractor may not recover damages for the period of the concurrency under the provisions of Article 6.6.2, and the maximum extension of the Contract Time shall be equal to the Excusable Delay or the Compensable Delay.

Concurrent Delays. 6.6.5.1. If an Inexcusable Delay occurs concurrently with either an Excusable Delay or a Compensable Delay, the Contractor may not recover damages for the period of the concurrency under the provisions of Article 6.6.2, and the maximum extension of the Contract Time shall be equal to the Excusable Delay or the Compensable Delay. 6.6.5.2. Notwithstanding the foregoing, the District’s failure to require compliance of any past delays shall not constitute a waiver or preclude it from enforcing such provisions in connection with any present or future delays.
