Condition of License. The License(s) granted to Customer under this Agreement are conditioned upon Customer’s compliance with the terms of this Agreement and the Order Form(s), including the timely payment of all applicable Fees.
Condition of License. Seller has maintained the License in the ordinary course of business. Seller makes no representations or warranties as to the condition of the License, and Seller disclaims any implied warranty as to the condition of the License, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Other than the express warranties set forth in this Agreement, the License is sold as-is, where-is.
