Common use of Conditions of the SIA’s Obligations Clause in Contracts

Conditions of the SIA’s Obligations. The SIA’s obligations hereunder are subject, during the term of this Agreement and the Offering, to: (a) the performance by the Dealer Manager of its obligations (including compliance by the Dealer Manager with its covenants and agreements set forth in Section 8); and (b) the conditions that (i) the Registration Statement shall become and remain effective, and (ii) no stop order shall have been issued suspending the effectiveness of the Offering.

Conditions of the SIA’s Obligations. The SIA’s 's obligations hereunder under this Agreement are subject, during the term of this Agreement and the Offeringoffering of the Units, to: (a) the performance by the Dealer Manager General Partner of its obligations (including under this Agreement and compliance by the Dealer Manager General Partner with its the covenants and agreements set forth in Section 8)9; and (b) the conditions that that: (i) the Registration Statement shall has become and remain remains effective, and ; and (ii) no stop order shall have has been issued suspending the effectiveness of the Offeringoffering of the Units.
