You agree that you are responsible for complying with all terms and conditions (including, without limitation, terms of payment) relating to any telecommunications service which is required by you to access or receive the Managed Security Service. 6.2 You agree to: a) provide an authorised technical contact, authorised contact number, and pass phrase, to keep any records of such details in separate places and take all necessary steps to ensure the security of such records; b) without prejudice to the General Terms and Conditions, keep such information private and confidential and ensure, at all times, that it (or they) does (do) not become known to any unauthorised personnel. 6.3 You agree that you will notify us immediately if you become aware of any change in circumstances which may lead you to believe that such information has become known to any unauthorised personnel. 6.4 You agree that we may, from time to time, suspend and/or change your pass phrase (at our discretion if we feel that such step is in the interests of security). 6.5 In the event that you wish to make alterations to configuration of any Firewall which we have supplied and in relation to which we have agreed to supply the Managed Security Service, you agree to contact our Technical Support Team (TST) to request such changes. Upon confirmation of authorisation, our TST will make such changes. 6.6 Any fault with the Services and/or the Equipment (in relation to which a "fault" shall mean a failure in any Firewall which we have supplied to you and which is preventing dataflow across the Firewall), which you detect must be reported to us as soon as possible either:- a) by telephone to the TST team on 0870 160 0650 during Business hours or; b) to such other telephone number as we may notify to you from time to time for this purpose.

You agree that you will provide us within 14 days with all information that we may reasonably require in order to provide the Services and perform all of our other obligations under this agreement. 6.2. If you breach the Agreement we may, at our sole discretion, either: 6.3.1. suspend or terminate this Agreement and/or any of the Services without notice or refund; 6.3.2. make an additional charge; or 6.3.3. block access to any part of the Services. 6.4. If, while using the Services, you discover that another person is using the Services, and failing to do so in accordance with the Agreement, you must inform us immediately. We undertake not to take any actions described in clause 6.3 above if it can be shown by you that you were unaware of a third party breaching the Agreement 6.5. You agree tothat you will, at all times and for whatever purpose, use the Services and/or the equipment in compliance within the Law. In addition you agree that you will not use, and will take all necessary precautions to ensure that nobody else uses, the Services and/or the Equipment: a) 6.5.1. fraudulently or in connection with any criminal offence; 6.5.2. to send, knowingly receive, upload, download, or use any material which is offensive, abusive, indecent, defamatory, obscene or menacing, or in breach of copyright, confidence, privacy or any other rights; 6.5.3. to cause annoyance, inconvenience or anxiety; 6.5.4. to “spam” or to send or provide an authorised technical contactunsolicited advertising or promotional material or, authorised contact numberknowingly to receive responses to any spam, unsolicited advertising or promotional material sent or provided by any third party; 6.5.5. in any way which, in our opinion, is or is likely to be detrimental to the provision of services to you or any of our customers, or to our business and/or reputation; 6.5.6. in contravention of any licences or third party rights, or in contravention of our Acceptable Use Policies; or 6.5.7. in a way that does not comply with any instructions provided to you; 6.6. You may use the Services to link to other networks world- wide, provided that you comply, at all times, with any policies and/or terms and pass phraseconditions imposed by the operators of such other networks. 6.7. You agree that you will not perform or allow anyone else to perform any unauthorised IP or Port multicasting, to spoofing, broadcasting, vectoring, filtering translation or routing. 6.8. You further agree that DBS shall be entitled at any time, at DBS’ sole discretion and without prior notice, to temporarily suspend the operation of any one or more of the Services for updating, maintenance and upgrading purposes, or any other purpose whatsoever that DBS deems fit, and in such event, DBS shall not be liable for any Losses or any liability which may be incurred as a result. 4.6 You hereby represent and declare that you understand and accept the following terms and conditions in relation to trading via the Services: 4.6.1 that electronic trading and order routing systems may differ from traditional open outcry pit trading, and that Transactions undertaken using an electronic system are subject to the rules and regulations of the relevant trading exchange(s) offering the system and/or listing the contract. In this purposeconnection, you hereby undertake, prior to engaging in such Transactions to familiarise yourself with, and from time to time to keep yourself updated on, the rules and regulations of the relevant trading exchange(s) offering the system and/or listing the relevant Transactions, and to understand, among other things, the system’s order matching procedure, opening and closing procedures and prices, error trade policies and trading limitations or requirements; and 4.6.2 that trading through an electronic trading or order routing system may expose you to risks associated with system or component failure. Such system or component failure may result in the inability to enter new orders, execute existing orders, or modify or cancel orders previously entered, as well as a loss of orders or order priority and in any of these events, DBS shall not be responsible for any Loss you may incur. 4.7 You represent, undertake and warrant that: 4.7.1 you have at all times the right, power and authority to use and/or access the Services to trade/communicate orders in the approved Transactions; 4.7.2 you are a market participant and are knowledgeable about Transactions and other interests traded or routed by use of the Services and appreciate and that you accept all risks related with trading via the Services; 4.7.3 you have received adequate instructions in respect of the operation and access of the Services; 4.7.4 you will comply with the applicable laws, rules and regulations of the relevant trading exchange(s) and applicable laws and regulations of any regulatory authorities; 4.7.5 the terms and conditions herein (including all attachments and appendices) are communicated and adhered to by all relevant parties and users of the Services; 4.7.6 you will provide all reasonable assistance to DBS and/or its suppliers in the event of an enquiry, audit or an investigation instigated by either any exchange, regulator and/or other supervisory or appropriate authority; 4.7.7 you will cooperate with and provide all reasonable assistance to any exchange, regulator and/or other appropriate authority for the purpose of conducting any audit, investigation and/or compliance review; and 4.7.8 you shall enter into such agreement(s) and/or execute such document(s) with or in favour of DBS, the Business Associates, or such other party or parties and upon such terms as DBS may require from time to time in respect of the Services and trading thereunder

Where ADSL is not available, a recommended alternative will be provided. 6.4 You agree to: (a) provide an authorised technical contact, authorised contact number, and pass phrase, to keep any records of such details in separate places and take all necessary steps to ensure the security of such records; (b) without prejudice to the General Terms and Conditions, keep such information private and confidential and ensure, at all times, that it (or they) does (do) not become known to any unauthorised personnel. 6.3 6.5 You agree that you will notify us immediately if you become aware of any change in circumstances which may lead you to believe that such information has become known to any unauthorised personnel. 6.4 6.6 You agree that we may, from time to time, suspend and/or change your pass phrase (at our discretion if we feel that such step is in the interests of security). 6.5 6.7 Any managed hardware, and/or routers, which you purchase from us, will be tested by us and configured to meet your basic network and Internet specifications. In the event that you wish to make alterations to configuration of any Firewall which we have supplied and in relation to which we have agreed to supply the Managed Security Servicesuch Equipment, you agree to contact our Technical the Support Team (TST) team at Orbital Net to request such changes. Upon confirmation of authorisation, our TST the Support team will make such changes. 6.6 6.8 Any fault with the Services and/or the Equipment (in relation to which a "fault" shall mean a failure in any Firewall which we have supplied to you and which is preventing dataflow across the Firewall)Equipment, which you detect must be reported to us as soon as possible either:- (a) by telephone to the TST Support team on 0870 160 0650 during Business hours or01233 80 70 60 8am to 6pm; (b) by telephone to the Support team on 01233 80 70 60 outside office hours; (c) to such other telephone number as we may notify to you from time to time for this purpose.
