Conditions Precedent for Concessioning Authority. The Concessionaire may, at any time after the signing of this Agreement, by notice require the Authority to satisfy any or all of the Conditions Precedent set forth in this Article 4.1 within a period not exceeding 90 (ninety) days from the date of the Notice, or such longer period not exceeding 180 days from the date of the Notice, and the Conditions Precedent required to be satisfied by the Authority shall be deemed to have been fulfilled when the Authority shall have: A. Provided the right of way of the Project Site, free from encumbrances, to the Concessionaire; B. Appointed an Independent Engineer, as per provisions of this Agreement (as per Schedule 11);
