Concession Period. The Concession Period shall be for a period of 27 years from the Compliance Date ("the Concession Period") during which the Concessionaire is authorised to implement the Project on DBFOT basis including management of all facilities and resources required for integrated management of Solid Waste in accordance with the provisions hereof: Provided that in the event of Termination, the Concession Period shall mean and be limited to the period commencing from the Compliance Date and ending with the Termination Date.
Concession Period. The Concession hereby granted is for a period of five ( 5) years commencing from the date hereof and ending with (“the Concession Period”) during which the Concessionaire is authorised to operate the Centre in accordance with the provisions hereof. Provided that the Hospital Authority shall be entitled to review the performance of the Concessionaire at the end of each year from the date hereof subjected to permission of departmental authorities. Provided that in the event of Termination, the Concession Period shall mean and be limited to the period commencing from the date hereof and ending with the Termination Date.
Concession Period. 3.2.1 Subject to early termination in accordance with this Agreement, the Concession is granted for a period of 10 (Ten) years commencing from the Effective Date (the "Concession Period").
3.2.2 Notwithstanding anything to the contrary stated in this Agreement, the Operator may request an extension of the Concession Period at any time at least one (01) year prior to the Expiry of Concession Period; provided that at the time of the request the Operator is materially in compliance with its obligations under this Agreement and is not otherwise facing a default therein. The Authority has a right to accept or reject this request for extension at its sole and absolute discretion.
Concession Period. The Concession hereby granted is for a period of nine (9) years from the Appointed Date or until termination thereof in accordance with the terms of this Agreement. (“Concession Period”). Provided that in the event of Termination, the Concession Period shall mean and be limited to the period commencing from the Appointed Date and ending with the Termination Date.
Concession Period. The period of Concession shall commence on the Execution Date of this Agreement and shall if not terminated earlier or extended by ADCL in accordance with the terms and conditions hereof, remain valid for a period of 33 (thirty three) Years from such date, during which the Concessionaire is authorized to implement the Project in accordance with the provisions of this Agreement (the “Concession Period”). For the avoidance of doubt, the Concession Period shall include the Construction Period.
Concession Period. 3.2.1 The concession period for the Project shall commence from the Appointed Date and shall extend for a period of 60 (Sixty) years from such date (the “Concession Period”).
3.2.2 The Concessionaire shall be required to complete construction of the Mandatory Development Obligations within a pre-defined period from the Appointed Date (“Construction Period”).
3.2.3 For the avoidance of doubt, the Concession Period shall include the Construction Period.
3.2.4 It is hereby made clear that:
a) In the event of the Concession Period being extended by the Concessioning Authority beyond the said period, in accordance with the provisions of this Concession Agreement, the Concession Period shall include the period / aggregate period by which the Concession is so extended, and
b) In the event of Termination, the Concession Period shall mean and be limited to the period commencing from the Appointed Date and ending with the Termination.
3.2.5 At the end of the Concession Period or early termination of this Concession Agreement for any reason whatsoever, all rights given under this Concession Agreement shall cease to have effect and the Project Facilities, in good and operational condition, shall revert to the Concessioning Authority without any obligation of Concessioning Authority to pay or adjust any consideration or other payment to the Concessionaire. For more details, please refer ARTICLE 25 of this Concession Agreement.
Concession Period. 3.2.1. The Concession Period shall commence from the Appointed Date and shall extend for a period of Forty (40) years, including construction period of 36 months or the earlier termination of this Agreement in terms hereof and during which the Concessionaire is authorized to implement the Project and to operate the Project Facility excluding MLCP in accordance withthe provisions hereof. For the avoidance of doubt, the Concession Period shall include the Construction Period. However on successful completion of initial Concession period, the concession period may be extended for maximum of another 30 years on “First Right of Refusal” basis.
3.2.2. It is hereby acknowledged that if the Authority decides to again bid for the Project on Public- Private-Partnership (PPP) basis within a period not later than one year from the date of end of 40 years from the Appointed Date, the Concessionaire shall be given “First Right of Refusal” for maximum period of another 30 years
3.2.3. In order to be granted the “First Right of Refusal”, the Concessionaire has to intimate his interest in writing to the Authority six months prior to the completion of the Concession Period, in order to become eligible to avail of the privilege of the “First Rightof Refusal”.
3.2.4. In the event the Concessionaire opts to exercise the “First Right of Refusal” and matches or Improves upon the bid of the highest bidder, the Project shall be awarded to the Concessionaire and the highest bidder whose bid has been matched or improved upon shall have no right for being declared as the Prospective Bidder.
3.2.5. However, the terms and conditions of the bidding process as well as those of the bidding documents shall be determined by the Authority at its sole discretion. It is hereby made clear that:
a) In the event of the Concession Period being extended by the Authority beyond the said period in accordance with the provisions of this Agreement, the Concession Period shall include the period/ aggregate period by which the Concession is so extended, and
b) In the event of Termination, the Concession Period shall mean and be limited to the period commencing from the Appointed Date and ending with the Termination;
3.2.6. At the end of the Concession Period or sooner termination of this Concession Agreement for any reason whatsoever, all rights given under this Concession Agreement shall cease to have effect and the Project Site, Project facility and Project Assets attached to the Project shall revert t...
Concession Period. Subject to early termination of this Agreement in accordance with its terms, the term of this Agreement is [33 (thirty-three)] years from the Execution Date (the “Concession Period”), which shall include 5 (five) years (the “Construction Period”) from the Appointed Date. The extension of the Concession Period for another 33 years shall be automatic, provided the Medical College and Hospital has all approvals under the Applicable Laws to undertake the continued operations of the Medical College, and a Concessionaire Default is not subsisting. Provided that the Concessionaire may request the Authority for the extension by submitting an application not later than the 30th year anniversary of the lease of Site for Medical College to the Authority and the Authority shall confirm the extension of lease within 90 days.
Concession Period. 3.3.1. The Concession Period for “the Project” shall commence from the Compliance Date and shall extend for a period of 30 (thirty) years from such date (the “Concession Period”) during which the Concessionaire is authorized to implement the Project and to operate the Ecotourism & Adventure Park in accordance with the provisions hereof. For the avoidance of doubt, the Concession Period shall include the Construction Period.
3.3.2. It is hereby made clear that:
(a) In the event of the Concession Period being extended by Authority beyond the said period in accordance with the provisions of this Concession Agreement, the Concession Period shall include the period/ aggregate period by which the Concession is so extended, and
(b) In the event of Termination, the Concession Period shall mean and be limited to the period commencing from the Compliance Date and ending with the Termination.
Concession Period a The Concession hereby granted is for a period of four (4) years commencing from the date (please mentioned the date of effect of this agreement as mentioned in the Memo No. Date: HFW-14015(99)/41/2018-SPSRC SEC-Dept. of H&FW / PPP/996 Date 12 /11/2018) hereof and ending with (“the Concession Period”) during which the Concessionaire is authorized to operate the Fair Price Outlet in accordance with the provisions hereof.
