CONDITIONS TO SUBSEQUENT CONSTRUCTION ADVANCES. Unless otherwise waived in writing by Lender, Lender shall have no obligation to make any Construction Advance after the first Construction Advance if the Title Company has not actually issued and delivered to Lender the Title Insurance Policy, together with such reinsurance agreements and direct access agreements as Lender shall designate as requirements on or before the Closing Date, all of which shall be in form and substance acceptable to Lender.
