The Confidentiality & Personal Data Protection clause establishes the obligation of parties to safeguard sensitive information and personal data exchanged during their relationship. Confidentiality & Personal Data Protection. 8.1. By providing its personal data on the Onlineshop when registering or placing the Order, the Buyer gives the Seller its voluntary consent to process, use (including transfer) its personal data, as well as to perform other actions provided by the Law of Ukraine On Personal Data Protection, with the storage period and in accordance with the goals and scope specified in the Doka Privacy Policy, which can be found at ▇▇▇▇▇://▇▇▇.▇▇▇▇.▇▇▇/ua/home/dataprivacy/index
8.2. The Seller undertakes not to disclose the information received from the Buyer. It shall not be considered a breach of Seller's disclosure of information to counterparties and third parties acting on the basis of a contract with the Seller, including in order to perform obligations to the Buyer, as well as in cases where disclosure of such information is required by applicable laws of Ukraine.
8.3. The Buyer is responsible for keeping his personal data up to date. The Seller shall not be liable for poor performance or failure to perform its obligations due to the irrelevance of the information about the Buyer or its inconsistency.
8.4. The purpose of personal data processing in the system is storage and maintenance of counterparty data in accordance with Articles 6, 7 of the Law of Ukraine On Personal Data Protection.
8.5. The purpose of personal data processing is to ensure implementation of the civil- law relations (ensuring implementation of the purchase-sale relations, consumer protection relations, advertising and market research of other cooperation), providing/receiving and making payments for the purchased goods/services in accordance with the Tax Code of Ukraine, the Law of Ukraine On Accounting and Financial Reporting in Ukraine. 8.6. By agreeing to this Agreement, the Buyer also gives its consent to the Seller to transfer (disclose) its data to shipping and courier companies, any banks and/or financial institutions and other third parties, subject to and for the purpose of achieving the purposes of data processing defined in 8.5, at the Seller's discretion.

Confidentiality & Personal Data Protection. The Vendor shall not announce or disclose the existence of any contractual arrangement between the Vendor and Purchaser or its terms unless specifically agreed by Purchaser in writing or as required by law. Any such announcement or disclosure by the Vendor shall in any event be made only after prior consultation with Purchaser and approval of Purchaser to the contents of the announcement or disclosure. Should there be obligations arising from any compliance requirements to Personal Data Protection Act 2010 to the information as provided by the Purchaser, the Vendor agrees to observe the terms and conditions as stated in Schedule 1 hereto.
Confidentiality & Personal Data Protection. 6.1. Any other provisions that were not mentioned within the current agreement shall be negotiated and inserted within an addendum, if both parties agrees with them.
6.2. One party of the contract has no right without the approval of the other party to:
a) disclose the contract, documents or any provision related to them, to his employees or to a third party, except to those people directly involved to the contract execution;
b) to use the information and documents obtained or to whom he has access within the period of contract execution for a different purpose related to the contract obligation execution.
6.3. In the event the regime of confidentiality related to the information and documents is not respected, the culpable party shall cover all material and image prejudice.
6.4. Any information revealing to the people involved in the contract execution shall be done with confidentiality and it shall be extended only to the necessary information related the contract execution.
6.5. One party can be absolved for revealing the information if:
a) the information was revealed to the party before the other party receive it; or
b) the information was revealed after the other party gave the approval in this respect; or
c) the party was legally obliged to reveal the information, or it is related to the company operations in front of the authorities, financial institutions or third parties involved with the contract execution.
Confidentiality & Personal Data Protection. Notwithstanding Clause 14, this Agreement and all matters pertaining hereto including but not limited to, all information relating to Cardholders/E-Wallet Users shall be considered as confidential in nature and shall not be disclosed by the Merchant to any third party unless the said disclosure is mandatory by law. You shall keep confidential any information you receive from us that is not publicly available and this Agreement and its terms and conditions, including, without limitation, your Merchant Discount and/or Merchant Fee. You shall take all steps necessary to prevent the transfer or disclosure of Cardholder’s/E-Wallet User’s information to any third party and will not copy, reproduce or store in any form the names and addresses of Cardholders/E-Wallet Users for any purpose whatsoever. For the avoidance of doubt, the obligations of this Clause 19 shall survive the termination or expiration of this Agreement. Notwithstanding anything to the contrary, the Parties additionally agree to be bound by the Personal Data Protection Act 2010 and the rules and regulations issued pursuant thereto.
