Common use of CONFIDENTIALITY; PUBLICATION; PUBLICITY Clause in Contracts

CONFIDENTIALITY; PUBLICATION; PUBLICITY. A. In fulfilling their obligations under this Agreement, it may be desirable or necessary for the parties to disclose to one another certain of their Confidential Information. In the event of receipt of such Confidential Information, the receiving party agrees to preserve such information as confidential and not to disclose it to third parties or to use it except in connection with this Agreement during the term of this Agreement and for a period of five (5) years following its termination. The foregoing obligations shall not apply to any information that: 1. is now in the public domain or becomes generally available to the public through no fault of the receiving party;
