Common use of Conflict with Common Terms Clause in Contracts

Conflict with Common Terms. If there is any conflict between the provisions of the Common Terms and the provisions of this Agreement, the provisions of this Agreement shall prevail, save (a) for any provision of this Agreement that conflicts with clause 6 (Recourse and Non-Petition) of the Common Terms, in which case clause 6 (Recourse and Non-Petition) of the Common Terms shall prevail and (b) for where any provision of this Agreement relates to VAT, in which case the provisions of the Common Terms shall prevail.

Conflict with Common Terms. If there is any conflict between the provisions of the Common Terms and the provisions of this Agreement, the provisions of this Agreement shall prevail, save (a) for any provision of this Agreement that conflicts with clause 6 (Recourse and Non-Petition) of the Common Terms, in which case clause 6 (Recourse and Non-Petition) of the Common Terms shall prevail and (b) for where any provision of this Agreement relates to VAT, in which case the provisions of the Common Terms shall prevailprevail and provided that the provisions of paragraph 6 (Limited Recourse; Non-Petition) of the Common Terms shall prevail at all times.
