Common use of Conflict with Third-Party Agreements Clause in Contracts

Conflict with Third-Party Agreements. Nothing in Sections 5.4 and 5.5 shall require Palm to violate any agreement with any third party regarding the confidentiality of confidential and proprietary information relating to that third party or its business; provided, however, that in the event that Palm is required under Sections 5.4 and 5.5 to disclose any such Information, Palm shall use all commercially reasonable efforts to seek to obtain such third party's consent to the disclosure of such information.
