Congé parental non payé a) L’employé-e qui est ou sera effectivement chargé des soins et de la garde d’un nouveau-né (y compris le nouveau-né du conjoint de fait) a droit, sur demande, à un congé parental non payé pour une seule période ne dépassant pas trente-sept (37) semaines consécutives au cours des cinquante-deux (52) semaines qui commencent le jour de la naissance de l’enfant ou le jour où l’enfant lui est confié. b) L’employé-e qui, aux termes d’une loi provinciale, engage une procédure d’adoption ou se fait délivrer une ordonnance d’adoption a droit, sur demande, à un congé parental non payé pour une seule période ne dépassant pas trente-sept (37) semaines consécutives au cours des cinquante-deux (52) semaines qui suivent le jour où l’enfant lui est confié. c) Nonobstant les alinéas a) et b) : (i) si l’employé-e n’a pas encore commencé son congé parental non payé et que son enfant est hospitalisé pendant la période susmentionnée, ou (ii) si l’employé-e a commencé son congé parental non payé puis retourne au travail pendant la totalité ou une partie de l’hospitalisation de son enfant, la période de congé parental non payé précisée dans la demande de congé initiale peut être prolongée d’une période égale à la partie de la période d’hospitalisation de l’enfant pendant laquelle l’employé-e n’était pas en congé parental. Toutefois, la prolongation doit se terminer au plus tard cent quatre (104) semaines après le jour où l’enfant lui est confié. d) L’employé-e qui a l’intention de demander un congé parental non payé en informe l’employeur au moins quatre (4) semaines avant la date prévue de la naissance de son enfant (y compris l’enfant du conjoint de fait) ou avant la date à laquelle l’employé-e prévoit se faire confier l’enfant conformément aux alinéas a) et b). e) L’employeur peut : (i) reporter à plus tard le début du congé parental non payé à la demande de l’employé-e; (ii) accorder à l’employé-e un congé parental non payé même si celui-ci ou celle-ci donne un préavis de moins de quatre (4) semaines; (iii) demander à l’employé-e de présenter un certificat de naissance ou une preuve d’adoption de l’enfant. f) Le congé parental non payé pris par un couple à l’emploi de l'ONF ne doit pas dépasser un total de trente-sept (37) semaines pour les deux employés ensemble. g) Le congé accordé en vertu du présent paragraphe est compté dans le calcul de la durée de l’« emploi continu » aux fins de l’indemnité de départ, de l'ancienneté et dans le calcul du « service » aux fins du con...

  • Subsidiaries; Capitalization As of the Effective Date, the Borrower has only the Subsidiaries set forth on, and the authorized, issued and outstanding Capital Stock of the Borrower and each such Subsidiary is as set forth on, Schedule 4.1.
