Interconnected Transmission Owner shall construct and, unless otherwise indicated, shall own, the following: 1. Attachment Facilities: Engineering and construction oversight for Attachment Facilities subject to the Option to Build. 2. Interconnection Customer shall construct, and Interconnected Transmission Owner shall own, the following: a) Attachment Facilities: Attachment Facilities subject to the Option to Build, as indicated in the Facilities Study, include the portion of the new 115 kV three-breaker ring bus substation associated solely with the generator lead line. The equipment associated with the Attachment Facilities include the metering accuracy capacitor voltage transformers (CCVTs), metering accuracy current transformers (CTs), disconnect switch, conductors, and connectors. b) Direct Connection Network Upgrades: New 115 kV three-breaker ring bus substation, subject to the Option to Build as indicated in the Facilities Study, located near Transmission Structure 119/413 on Interconnected Transmission Owner’s 119 Line from Grottoes Substation to Merck No. 5 Substation. The cut line will consume two of the positions in the ring bus. The third position will be for the generator lead line. The Interconnected Transmission Owner shall complete all Transmission Owner Interconnection Facilities set forth in Schedules C and I of this CSA and provide back feed to the Interconnection Customer’s Customer Facilities by December 31, 2023. The Interconnection Customer shall commence the scope of work identified in Schedules G and I of this CSA one month after both full execution of this CSA and completion of the construction kickoff call. Interconnection Customer shall complete all Customer Interconnection Facilities set forth in Schedules G and I of this CSA by December 31, 2023. Applicable Technical Requirements and Standards are set forth in the following documents: • “Requirements for Connection of New Facilities or Changes to Existing Facilities Connected to the AEP Transmission System,” Revision 3 dated June 30, 2021; and • “Standards and Expectations for Siting, Real Estate, Right-of-Way, and Environmental Permitting for Transmission Interconnection Projects,” Version 2 dated August 20, 2020. To the extent that these Applicable Technical Requirements and Standards conflict with the terms and conditions of the Tariff or any other provision of this ISA, the Tariff and/or this ISA shall control. As provided in Section 2.4.1 of Appendix 2 to this CSA and subject to the requirements thereof, Interconnection Customer represents that it meets all qualifications and requirements as set forth in Section 118(a) and 118(b) of the Internal Revenue Code of 1986, as amended and interpreted by Notice 2016-36, 2016-25 I.R.B. (6/20/2016) (the “IRS Notice”). Interconnection Customer agrees to conform with all requirements of the safe harbor provisions specified in the IRS Notice, as they may be amended, as required to confer non-taxable status on some or all of the transfer of property, including money, by Interconnection Customer to Interconnected Transmission Owner with respect to the payment of the Costs of construction and installation of the Transmission Owner Interconnection Facilities specified in this CSA. Nothing in Interconnection Customer’s agreement pursuant to this Schedule L shall change Interconnection Customer’s indemnification obligations under Section 2.4.2 of Appendix 2 to the CSA. A. Interconnection Customer portion of 115kV generator lead line extending from the high side of the collection substation to the point of change of ownership with VEPCO#n6902. Interconnection Customer shall construct and, unless otherwise indicated, shall own, the following Interconnection Facilities: a) 115 kV line beginning at the high side of the 115/34.5/13.8 kV main power transformer (“MPT”) and extending to the point of change of ownership with VEPCO; b) 115 kV circuit breaker; and c) Communication equipment to VEPCO’s bidirectional metering equipment. Interconnection Customer shall construct and, unless otherwise indicated, shall own, the following Interconnection Facilities: a) 115 kV line beginning at the high side of the MPT and extending to the point of change of ownership with VEPCO; b) 115 kV circuit breaker; and c) Communication equipment to VEPCO’s bidirectional metering equipment. Interconnected Transmission Owner shall construct and, unless otherwise indicated, shall own, the following: 1. ) 115 kV line beginning at the point of change of ownership with Interconnection Customer and extending to the new three breaker 115 kV switching station; 2) One (1) 115kV circuit breaker115 kV, 2000A, 3-phase center break gang operated switch; 3) Three (3) 115 kV metering accuracy coupling capacitor voltage transformers; 4) Three (3) 115 kV metering accuracy current transformers; and 5) Conductors, connectors, conduits, control cables, foundations, steel structures, and grounding. 6) New three breaker 115 kV switching station. PJM Network Upgrade #n6900. 7) Re-arrange line #44 to loop into and out of the new three breaker 115 kV switching station. PJM Network Upgrade #n6901. 8) Remote protection and communication work. PJM Network Upgrade #n6902. Interconnected Transmission Owner shall commence the scope of work identified in Schedules C and I of this CSA one month after both full execution of this CSA and completion of the construction kickoff call. Interconnected Transmission Owner shall complete all facilities set forth in Schedule C of this CSA and provide back feed to the Customer Facility by October 15, 2024. Interconnection Customer shall commence the scope of work identified in Schedules G and I of this CSA one month after both full execution of this CSA and completion of the construction kickoff call. Interconnection Customer shall complete all Customer Interconnection Facilities set forth in Schedule G of this CSA by October 15, 2024. Dominion Energy Facility Interconnection Requirements revision 20.0, dated April 1, 2022, shall apply. To the extent that these Applicable Technical Requirements and Standards conflict with the terms and conditions of the Tariff or any other provision of this CSA, the Tariff and/or this CSA shall control. As provided in Section 2.4.1 of Appendix 2 to this CSA and subject to the requirements thereof, Interconnection Customer represents that it meets all qualifications and requirements as set forth in Section 118(a) and 118(b) of the Internal Revenue Code of 1986, as amended and interpreted by Notice 2016-36, 2016-25 I.R.B. (6/20/2016) (the “IRS Notice”). Interconnection Customer agrees to conform with all requirements of the safe harbor provisions specified in the IRS Notice, as they may be amended, as required to confer non-taxable status on some or all of the transfer of property, including money, by Interconnection Customer to Interconnected Transmission Owner with respect to the payment of the Costs of construction and installation of the Transmission Owner Interconnection Facilities specified in this CSA.
