Common use of Consequences of Events of Default and Corrective Action Clause in Contracts

Consequences of Events of Default and Corrective Action. If an Event of Default occurs, the Province may, at any time, take one or more of the following actions: (a) initiate any action the Province considers necessary in order to facilitate the successful continuation or completion of the Project; (b) provide the Recipient with an opportunity to remedy the Event of Default; (c) suspend the payment of Funds for such period as the Province determines appropriate; (d) reduce the amount of the Funds; (e) cancel further instalments of Funds; (f) demand from the Recipient the payment of any Funds remaining in the possession or under the control of the Recipient; (g) demand from the Recipient the payment of an amount equal to any Funds the Recipient used, but did not use in accordance with the Agreement; (h) demand from the Recipient the payment of an amount equal to any Funds the Province provided to the Recipient; and (i) terminate the Agreement at any time, including immediately, without liability, penalty or costs to the Province upon giving Notice to the Recipient.

Consequences of Events of Default and Corrective Action. If an Event of Default occurs, the Province may, at any time, and at its sole discretion, take one or more of the following actions: (a) initiate any action the Province considers necessary in order to facilitate the successful continuation or completion of the Project; (b) provide the Recipient with an opportunity to remedy the Event of Default; (c) suspend the payment of Funds for such period as the Province determines appropriate; (d) reduce the amount of the Funds; (e) cancel all further instalments of Funds; (f) demand from the Recipient the payment of any Funds plus any Interest Earned remaining in the possession or under the control of the Recipient; (g) demand from the Recipient the payment of an amount equal to any Funds the Recipient used, but did not use in accordance with the Agreement; (h) demand from the Recipient the payment repayment of an amount equal to any Funds the Province provided to the Recipient; (i) demand from the Recipient an amount equal to the costs the Province incurred or incurs to enforce its rights under the Agreement, including the costs of any Records Review and the costs it incurs to collect any amounts the Recipient owes to the Province; and (ij) terminate the Agreement at any time, including immediately, without liability, penalty penalty, or costs to the Province upon giving Notice to the Recipient.

If an Event of Default occurs, the Province may, at any time, take one or more of the following actions: (a) initiate any action the Province considers necessary in order to facilitate the successful continuation or completion of the Projectany Service; (b) provide the Recipient with an opportunity to remedy the Event of Default; (c) suspend the payment of Funds for such period as the Province determines appropriate; (d) reduce the amount of the Funds; (e) cancel further instalments of Funds; (f) demand from the Recipient the payment of any Funds remaining in the possession or under the control of the Recipient; (g) demand from the Recipient the payment of an amount equal to any Funds the Recipient used, but did not use in accordance with the Agreement; (h) demand from the Recipient the payment of an amount equal to any Funds the Province provided to the Recipient; and (i) terminate the Agreement at any time, including immediately, without liability, penalty or costs to the Province upon giving Notice to the Recipient.

If an Event of Default occurs, the Province maymay take, at any time, take without liability, penalty or costs to the Province, one or more of the following actions: (a) : initiate any action the Province considers necessary in order to facilitate the successful continuation or completion of the Project; (b) Program; provide the Recipient with an opportunity to remedy the Event of Default; (c) ; suspend the payment of Funds for such period as the Province determines appropriate; (d) ; reduce the amount of the Funds; (e) ; cancel all further instalments of Funds; (f) ; demand from the Recipient the payment repayment of any Funds remaining in the possession or under the control of the Recipient; (g) ; demand from the Recipient the payment repayment of an amount equal to any Funds the Recipient used, but did not use in accordance with the Agreement; (h) ; demand from the Recipient the payment repayment of an amount equal to any Funds the Province provided to the Recipient; and (i) terminate the Agreement at any time, including immediately, without liability, penalty or costs to the Province and upon giving Notice to the Recipient, terminate the Agreement.

If an Event of Default occurs, the Province may, at any time, take one or more of the following actions: (a) initiate any action the Province considers necessary in order to facilitate the successful continuation or completion of the ProjectProgram; (b) provide the Recipient with an opportunity to remedy the Event of Default; (c) suspend the payment of Funds for such period as the Province determines appropriate; (d) reduce the amount of the Funds; (e) cancel all further instalments of Funds; (f) demand from the Recipient the payment repayment of any Funds remaining in the possession or under the control of the Recipient; (g) demand from the Recipient the payment repayment of an amount equal to any Funds the Recipient used, but did not use in accordance with the Agreement; (h) demand from the Recipient the payment repayment of an amount equal to any Funds the Province provided to the Recipient; and (i) terminate the Agreement at any time, including immediately, without liability, penalty or costs to the Province upon giving Notice to the Recipient.

Consequences of Events of Default and Corrective Action. If an Event of Default occurs, the Province may, at any time, take one or more of the following actions: (a) initiate Initiate any action the Province considers necessary in order to facilitate the successful continuation or completion of the Project; (b) provide Provide the Recipient with an opportunity to remedy the Event of Default; (c) suspend Suspend the payment of Funds for such a period as the Province determines appropriate; (d) reduce Reduce the amount of Funds; (e) Cancel any further installments of the Funds; (e) cancel further instalments of Funds; (f) demand from Demand the Recipient the payment repayment of any Funds plus any Interest Earned thereon remaining in the possession or under the control of the Recipient; (g) demand from Demand the Recipient the payment repayment of an amount equal to any Funds the Recipient usedused plus any Interest Earned thereon, but did not use in accordance with the terms and conditions of this Agreement; (h) demand from Demand the Recipient the payment repayment of an amount equal to any Funds the Province provided to the RecipientRecipient plus any Interest Earned thereon, even though the Project is partially completed; and (i) terminate the Terminate this Agreement at any time, including immediately, without liability, penalty or costs to the Province upon giving Notice to the Recipient.
