Common use of Consequences of Failing an Alcohol Clause in Contracts

Consequences of Failing an Alcohol. and/or Drug Test A positive result from a drug or alcohol test may result in disciplinary action, up to and including termination, in accordance with the County’s existing disciplinary rules and procedures. Examples that, when combined with a positive drug or alcohol test, will merit strong consideration for termination include extreme circumstances such as: consumption of alcohol while on duty; ingestion of drugs or other controlled substances while on duty; sale of drugs while on duty; criminal activities associated with drugs or controlled substances. In addition to the above, the failure of a drug/alcohol test (excluding first time failure of a random test) may be used, in conjunction with other job performance indicators for a determination of appropriate discipline up to and including termination.
